A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the election of the members of the board of trustees of
1-3 South Texas Community College.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 130.0311, Education Code, is amended by
1-6 amending Subsections (c), (m), and (n) and adding Subsection (o) to
1-7 read as follows:
1-8 (c) South Texas Community College is governed by an initial
1-9 board of trustees composed of seven members appointed by the
1-10 governor to serve until <the earlier of> August 31, 2000, unless
1-11 before that <or the> date <that> an election is held at which a
1-12 majority of the votes cast at the election favor the confirmation
1-13 of the college. In that event, as soon as practicable after the
1-14 confirmation election the members of the initial board of trustees
1-15 shall draw lots to determine when their terms expire. The terms of
1-16 two members expire on the first Saturday in May in the first
1-17 even-numbered year after the date of the confirmation election, the
1-18 terms of two members expire on the first Saturday in May in the
1-19 second even-numbered year after the date of the confirmation
1-20 election, and the terms of three members expire on the first
1-21 Saturday in May in the third even-numbered year after the date of
1-22 the confirmation election.
1-23 (m) If South Texas Community College is confirmed as
1-24 provided by this section, two members of the board of trustees
2-1 shall be elected on the first Saturday in May in the first
2-2 even-numbered year after the date of the confirmation election, two
2-3 members shall be elected on the first Saturday in May in the second
2-4 even-numbered year after the date of the confirmation election, and
2-5 three members shall be elected on the first Saturday in May in the
2-6 third even-numbered year after the date of the confirmation
2-7 election.
2-8 (n) If South Texas Community College is not confirmed in
2-9 accordance with this section before August 31, 2000, the college is
2-10 abolished on that date.
2-11 (o) <(n)> This section expires January 1, 2001.
2-12 SECTION 2. The importance of this legislation and the
2-13 crowded condition of the calendars in both houses create an
2-14 emergency and an imperative public necessity that the
2-15 constitutional rule requiring bills to be read on three several
2-16 days in each house be suspended, and this rule is hereby suspended,
2-17 and that this Act take effect and be in force from and after its
2-18 passage, and it is so enacted.
