                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the eligibility for unemployment compensation benefits
    1-3  of certain employees of educational institutions.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 207.041(b), Labor Code, is amended to
    1-6  read as follows:
    1-7        (b)  Benefits are not payable to an individual based on
    1-8  services performed for an educational institution in a capacity
    1-9  other than a capacity described by Subsection (a) for a week that
   1-10  begins during a period between two successive academic years or
   1-11  terms if:
   1-12              (1)  the individual performed the services in the first
   1-13  of the academic years or terms; and
   1-14              (2)  there is a reasonable assurance that the
   1-15  individual will perform substantially the same services in the
   1-16  second of the academic years or terms.
   1-17        SECTION 2.  This Act takes effect September 1, 1995, and
   1-18  applies only to a claim for unemployment compensation benefits that
   1-19  is filed with the Texas Employment Commission on or after January
   1-20  1, 1996.  A claim filed before January 1, 1996, is governed by the
   1-21  law as it existed immediately before the effective date of this
   1-22  Act, and that law is continued in effect for that purpose.
   1-23        SECTION 3.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
