    1-1                                AN ACT
    1-2  relating to exemptions from the study requirements applicable to
    1-3  local recording agents.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 5a(b), Article 21.14, Insurance Code, is
    1-6  amended to read as follows:
    1-7        (b)  Provided, however, none of the provisions of this
    1-8  section shall apply to the following:
    1-9              (1)  To any person holding a license as a local
   1-10  recording agent upon the effective date of this Act.
   1-11              (2)  To any person applying for an emergency local
   1-12  recording agent's license under the provisions of Section 6a of
   1-13  Article 21.14 of the Insurance Code of Texas.
   1-14              (3)  To any person who holds the designation Chartered
   1-15  Property and Casualty Underwriter (C.P.C.U.) from the American
   1-16  Institute for C.P.C.U., <Property and Liability Underwriters or>
   1-17  the designation Certified Insurance Counselor (C.I.C.) from the
   1-18  national Society of Certified Insurance Counselors, or the
   1-19  designation Accredited Adviser in Insurance (A.A.I.) from the
   1-20  Insurance Institute of America.
   1-21              (4)  To any person who has a bachelor's degree from a
   1-22  four-year accredited college or university with a major in
   1-23  insurance.
   1-24              (5)  To any person who within two (2) years immediately
    2-1  preceding the filing of an application was a licensed agent in good
    2-2  standing in the state from which the person moved to Texas,
    2-3  provided such state makes similar provision for those agents who
    2-4  may move from Texas to such state.
    2-5              (6)  To any person desiring to apply for a license to
    2-6  solicit and write exclusively all forms of insurance authorized to
    2-7  be solicited and written in Texas covering the ownership,
    2-8  operation, maintenance or use of any motor vehicle, its accessories
    2-9  and equipment, designed for use upon the public highways, including
   2-10  trailers and semitrailers.  Such person shall continue to apply for
   2-11  and qualify to be licensed under the other provisions of Article
   2-12  21.14 of the Insurance Code of Texas.  Provided, such applicant
   2-13  shall be required to take and pass, to the satisfaction of the
   2-14  Texas Department <State Board> of Insurance, an examination,
   2-15  promulgated by said department <Board>, covering only those forms
   2-16  of insurance referred to in this paragraph.  Provided, when such a
   2-17  person so applies and qualifies, the person shall be issued a
   2-18  license which shall contain on the face of said license the
   2-19  following language:  "Motor vehicle insurance only."  An agent
   2-20  holding such a limited license hereby created shall solicit only
   2-21  those forms of insurance hereinabove provided, but shall be subject
   2-22  to all other laws relating to local recording agents.
   2-23        SECTION 2.  The importance of this legislation and the
   2-24  crowded condition of the calendars in both houses create an
   2-25  emergency and an imperative public necessity that the
   2-26  constitutional rule requiring bills to be read on three several
   2-27  days in each house be suspended, and this rule is hereby suspended,
    3-1  and that this Act take effect and be in force from and after its
    3-2  passage, and it is so enacted.
