By McDonald H.B. No. 2382 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the training of food service workers. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 438.043, Health and Safety Code, is 1-5 amended by adding Subsection 438.043(e) to read as follows: 1-6 (e) The department may modify the requirements of 1-7 Subsections (a), (b) and (c) for a course used in training 1-8 employees under the common control of a single entity. 1-9 SECTION 2. Section 438.046(b), Health and Safety Code, is 1-10 amended to read as follows: 1-11 (b) A local health jurisdiction that requires training for a 1-12 food service worker shall accept as sufficient to meet the 1-13 jurisdiction's training and testing requirements a training course 1-14 that is accredited by the department and listed with the registry. 1-15 A food service worker trained in a course for the employees of a 1-16 single entity shall be deemed to have met a local jurisdiction's 1-17 training and testing requirements only as to food service performed 1-18 for that entity. 1-19 SECTION 3. The importance of this legislation and the 1-20 crowded condition of the calendars in both houses create an 1-21 emergency and an imperative public necessity that the 1-22 constitutional rule requiring bills to be read on three several 1-23 days in each house to be suspended, and this rule is hereby 2-1 suspended.
