A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the composition of certain judicial districts.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Sections 24.104, 24.106, 24.108, 24.109, 24.110,
1-5 24.116, 24.123, 24.124, 24.133, 24.135, 24.161, 24.164, 24.185,
1-6 24.202, 24.204, 24.216, 24.253, 24.375, 24.384, 24.389, 24.430,
1-7 24.451, 24.453, 24.464, and 24.624, Government Code, are amended to
1-8 read as follows:
1-9 Sec. 24.104. 4th Judicial District (Panola and Rusk Counties
1-10 <County>). (a) The 4th Judicial District is composed of Panola
1-11 and Rusk counties <County>.
1-12 (b) The terms of the 4th District Court begin on the first
1-13 Mondays in January, March, May, July, September, and November.
1-14 Sec. 24.106. 6th Judicial District (Delta <Fannin>, Lamar,
1-15 and Red River Counties). (a) The 6th Judicial District is
1-16 composed of Delta <Fannin>, Lamar, and Red River counties.
1-17 (b) In addition to other jurisdiction provided by law, each
1-18 district court in Red River County has the civil and criminal
1-19 jurisdiction of a county court.
1-20 (c) In Red River County, the 6th Judicial District has
1-21 concurrent jurisdiction with the 102nd Judicial District. In Lamar
1-22 County, the 6th Judicial District has concurrent jurisdiction with
1-23 the 62nd Judicial District.
1-24 (d) In any county in the district in which there are two or
2-1 more district courts, the judges of those courts may, in their
2-2 discretion, either in termtime or in vacation, on motion of any
2-3 party, on agreement of the parties, or on their own motion,
2-4 transfer any civil or criminal case or proceeding on their dockets
2-5 to the docket of one of the other district courts. In Lamar
2-6 County, the judges may transfer a case by an order entered in the
2-7 minutes of the transferring court. The judges of the courts may,
2-8 in their discretion, exchange benches or districts from time to
2-9 time. Any of the judges may in his own courtroom try and determine
2-10 any case or proceeding pending in any of the other courts without
2-11 having the case transferred or may sit in any of the other courts
2-12 and hear and determine any case or proceeding pending in one of
2-13 those courts. Two or more judges may try different cases in the
2-14 same court at the same time and each may occupy his own courtroom
2-15 or the room of any other court. In case of absence, sickness, or
2-16 disqualification of any of the judges, any other of the judges may
2-17 hold court for him. Any of the judges may hear and determine any
2-18 part or question of any case or proceeding pending in any of the
2-19 courts, and any other of the judges may complete the hearing and
2-20 render judgment in the proceeding. Any of the judges may hear and
2-21 determine motions, petitions for injunction, applications for
2-22 appointment of receivers, interventions, motions to transfer venue,
2-23 pleas in abatement and all dilatory pleas, motions for new trials,
2-24 and all preliminary matters, questions, and proceedings, and may
2-25 enter judgment or order on them in the court in which the case or
2-26 proceeding is pending without having the matter transferred to the
2-27 court of the acting judge. The judge in whose court the matter is
3-1 pending may proceed to hear, complete, and determine the matter or
3-2 all or any part of any other matter and may render final judgment
3-3 on it. Any of the judges of the courts may issue restraining
3-4 orders and injunctions returnable to any of the other courts. This
3-5 subsection does not limit the powers of the judges when acting for
3-6 any other judge by exchange of benches or otherwise.
3-7 (e) The terms of the 6th District Court in each county in
3-8 the district begin on the first Mondays in January and July.
3-9 Sec. 24.108. 8th Judicial District (<Delta,> Franklin,
3-10 Hopkins, and Wood <Rains> Counties). (a) The 8th Judicial
3-11 District is composed of <Delta,> Franklin, Hopkins, and Wood
3-12 <Rains> counties.
3-13 (b) In any county in the district in which there are two or
3-14 more district courts, those district courts have concurrent
3-15 jurisdiction in that county.
3-16 (c) In any county in the district in which there are two or
3-17 more district courts, the judges of those courts may, in their
3-18 discretion, either in termtime or in vacation, on motion of any
3-19 party, on agreement of the parties, or on their own motion,
3-20 transfer any civil or criminal case or proceeding on their dockets
3-21 to the docket of one of the other district courts. The judges in
3-22 <Delta and> Franklin counties may transfer a case by an order

5-1 Sec. 24.109. 9th Judicial District (Montgomery<, Polk, San
5-2 Jacinto,> and Waller Counties). (a) The 9th Judicial District is
5-3 composed of Montgomery<, Polk, San Jacinto,> and Waller counties.
5-4 (b) <In Polk County, the 9th Judicial District has
5-5 concurrent jurisdiction with the county court in all misdemeanor
5-6 cases in which the county court has jurisdiction. Misdemeanor
5-7 cases may be filed in either the district or county court and may
5-8 be transferred from one court to another. A misdemeanor case in
5-9 which the courts have concurrent jurisdiction may not be
5-10 transferred from one court to another without the consent of the
5-11 judge of the court to which it is transferred.>
5-12 <(c)> The 9th and l55th district courts have concurrent
5-13 jurisdiction in Waller County.
5-14 (c) <(d)> The terms of the 9th District Court begin:
5-15 (1) in Montgomery County on the 16th Monday after the
5-16 first Monday in January and the 18th Monday after the first Monday
5-17 in July;
5-18 <(2) in Polk County on the first Monday in January and
5-19 the third Monday in July;>
5-20 <(3) in San Jacinto County on the seventh Monday after
5-21 the first Monday in January and the ninth Monday after the first
5-22 Monday in July;> and
5-23 (2) <(4)> in Waller County on the 10th Monday after
5-24 the first Monday in January and the 12th Monday after the first
5-25 Monday in July.
5-26 Sec. 24.110. Second 9th Judicial District (Montgomery
5-27 County<, Polk, San Jacinto, and Trinity Counties>). (a) The
6-1 Second 9th Judicial District is composed of Montgomery County<,
6-2 Polk, San Jacinto, and Trinity counties>.
6-3 (b) <In Polk County, the Second 9th Judicial District has
6-4 concurrent jurisdiction with the county court in all misdemeanor
6-5 cases in which the county court has jurisdiction. Misdemeanor
6-6 cases may be filed in either the district or county court and may
6-7 be transferred from one court to another. A misdemeanor case in
6-8 which the courts have jurisdiction may not be transferred from one
6-9 court to another without the consent of the judge of the court to
6-10 which it is transferred.>
6-11 <(c)> The terms of the Second 9th District Court begin<:>
6-12 <(1) in Montgomery County> on the third Monday in
6-13 January, the eighth Monday after the first Monday in January, the
6-14 third Monday in July, and the 10th Monday after the first Monday in
6-15 July<;>
6-16 <(2) in Polk County on the 18th Monday after the first
6-17 Monday in January and the 20th Monday after the first Monday in
6-18 July;>
6-19 <(3) in San Jacinto County on the 16th Monday after
6-20 the first Monday in January and the 18th Monday after the first
6-21 Monday in July; and>
6-22 <(4) in Trinity County on the first Monday in January
6-23 and the 23rd Monday after the first Monday in January>.
6-24 Sec. 24.116. 15th Judicial District (Fannin and Grayson
6-25 Counties <County>). (a) The 15th Judicial District is composed of
6-26 Fannin and Grayson counties <County>.
6-27 (b) The 15th and 59th judicial districts have concurrent
7-1 jurisdiction in Grayson County.
7-2 (c) The terms of the 15th District Court begin on the first
7-3 Mondays in January, April, July, and October.
7-4 Sec. 24.123. 22nd Judicial District (Blanco, Caldwell,
7-5 Comal, and Hays Counties). (a) The 22nd Judicial District is
7-6 composed of Blanco, Caldwell, Comal, and Hays counties.
7-7 (b) In addition to other jurisdiction provided by law, each
7-8 district court in Comal County has the civil and criminal
7-9 jurisdiction of a county court.
7-10 (c) The terms of the 22nd District Court begin:
7-11 (1) in Blanco County on the first Mondays in February
7-12 and September;
7-13 (2) in Caldwell County on the first Mondays in March,
7-14 June, September, and December;
7-15 (3) <(2)> in Comal County on the first Mondays in
7-16 April, July, October, and January; and
7-17 (4) <(3)> in Hays County on the first Mondays in
7-18 February, May, August, and November.
7-19 Sec. 24.124. 23rd Judicial District (Brazoria and<,>
7-20 Matagorda<, and Wharton> Counties). (a) The 23rd Judicial
7-21 District is composed of Brazoria and<,> Matagorda<, and Wharton>
7-22 counties.
7-23 (b) The terms of the 23rd District Court begin:
7-24 (1) in Brazoria County on the first Mondays in April
7-25 and October, and the terms are designated the April-September and
7-26 October-March terms; and
7-27 (2) in Matagorda County on the first Mondays in June
8-1 and December, and the terms are designated the June-November and
8-2 December-May terms<; and>
8-3 <(3) in Wharton County on the first Mondays in July
8-4 and January, and the terms are designated the July-December and
8-5 January-June terms>.
8-6 (c) There is one general docket for the 23rd and 130th
8-7 district courts in Matagorda County. All suits and proceedings
8-8 within the jurisdiction of the courts in Matagorda County shall be
8-9 addressed to the district court of Matagorda County. All
8-10 citations, notices, restraining orders, and other process issued in
8-11 Matagorda County by the clerk or judges of the courts are
8-12 returnable to the district court of Matagorda County without
8-13 reference to the court number. On return of the process the judge
8-14 of either court may preside over the hearing or trial. The judges
8-15 of the 23rd and 130th district courts in Matagorda County may hear
8-16 and dispose of any matter on the courts' general docket without
8-17 transferring the matter.
8-18 (d) The Matagorda County district clerk shall keep one set
8-19 of minutes in which the clerk shall record all judgments and orders
8-20 of the 23rd and 130th district courts in Matagorda County. Each of
8-21 the judges of the 23rd and 130th district courts in Matagorda
8-22 County shall sign the minutes of each term of those courts not
8-23 later than the 30th day after the end of each term, shall sign the
8-24 minutes at the end of each column of the minutes, and shall sign
8-25 the minutes of the proceedings that were held before him.
8-26 (e) Each of the judges of the 23rd and 130th district courts
8-27 may take a vacation and not attend court for six weeks in each
9-1 year. The judges by agreement between themselves shall take their
9-2 vacations alternately so that there are at all times at least one
9-3 judge in his judicial district.
9-4 <(f) There is one general docket for the 23rd and 329th
9-5 district courts in Wharton County. All suits and proceedings
9-6 within the jurisdiction of the courts in Wharton County shall be
9-7 addressed to the district court of Wharton County. All citations,
9-8 notices, restraining orders, and other process issued in Wharton
9-9 County by the clerk or judges of the courts are returnable to the
9-10 district court of Wharton County without reference to the court
9-11 number. On return of the process the judge of either court may
9-12 preside over the hearing or trial. The judges of the 23rd and
9-13 329th district courts in Wharton County may hear and dispose of any
9-14 matter on the courts' general docket, both civil and criminal,
9-15 without transferring the matter.>
9-16 <(g) The Wharton County district clerk shall keep one set of
9-17 minutes in which the clerk shall record all judgments and orders of
9-18 the 23rd and 329th district courts in Wharton County. Each of the
9-19 judges of the 23rd and 329th district courts in Wharton County
9-20 shall sign the minutes of each term of those courts not later than

9-24 Sec. 24.133. 31st Judicial District (<Gray,> Hemphill,
9-25 Lipscomb, Roberts, and Wheeler Counties). (a) The 31st Judicial
9-26 District is composed of <Gray,> Hemphill, Lipscomb, Roberts, and
9-27 Wheeler counties.
10-1 (b) The terms of the 31st District Court begin:
10-2 (1) <in Gray County on the first Mondays in January
10-3 and July;>
10-4 <(2)> in Hemphill County on the second Monday in April
10-5 and the first Monday in November;
10-6 (2) <(3)> in Lipscomb County on the fourth Monday in
10-7 March and the second Monday in September;
10-8 (3) <(4)> in Roberts County on the second Monday in
10-9 March and the fourth Monday in August; and
10-10 (4) <(5)> in Wheeler County on the fourth Mondays in
10-11 April and November.
10-12 Sec. 24.135. 33rd Judicial District (<Blanco,> Burnet,
10-13 Llano, Mason, and San Saba Counties). (a) The 33rd Judicial
10-14 District is composed of <Blanco,> Burnet, Llano, Mason, and San
10-15 Saba counties.
10-16 (b) <(c)> The terms of the 33rd District Court begin:
10-17 (1) <in Blanco County on the first Mondays in February
10-18 and September;>
10-19 <(2)> in Burnet County on the fourth Mondays in April
10-20 and November;
10-21 (2) <(3)> in Llano County on the first Mondays in
10-22 April and November;
10-23 (3) <(4)> in Mason County on the second Mondays in
10-24 January and June; and
10-25 (4) <(5)> in San Saba County on the second Mondays in
10-26 March and October.
10-27 Sec. 24.161. 59th Judicial District (Fannin and Grayson
11-1 Counties <County>). (a) The 59th Judicial District is composed of
11-2 Fannin and Grayson counties <County>.
11-3 (b) The terms of the 59th District Court begin in Grayson
11-4 County on the first Mondays in January, April, July, and October
11-5 and in Fannin County on the first Mondays in January and July.
11-6 (c) The judge of the 59th District Court may impanel the
11-7 grand jury in Grayson County as provided by law for any terms of
11-8 his court that he considers proper.
11-9 (d) Section 24.116, relating to the 15th District Court,
11-10 contains provisions applicable to both that court and the 59th
11-11 District Court.
11-12 Sec. 24.164. 62nd Judicial District (Delta, <Franklin,
11-13 Hopkins, and> Lamar, and Red River Counties). (a) The 62nd
11-14 Judicial District is composed of Delta, <Franklin, Hopkins, and>
11-15 Lamar, and Red River counties.
11-16 (b) In any county in the district in which there are two or
11-17 more district courts, those district courts have concurrent
11-18 jurisdiction in that county.
11-19 (c) The terms of the 62nd District Court in Delta and Lamar
11-20 counties <each county> begin on the first Mondays in January and
11-21 July and in Red River County on the first Mondays in February, May,
11-22 August, and November.
11-23 (d) The judge of the 62nd District Court is not required to
11-24 impanel a grand jury in that court in any county of the district
11-25 unless the judge considers it necessary.
11-26 (e) <Section 24.108, relating to the 8th District Court,
11-27 contains provisions applicable to both that court and the 62nd
12-1 District Court in Delta, Franklin, and Hopkins counties.>
12-2 <(f)> Section 24.106, relating to the 6th District Court,
12-3 contains provisions applicable to both that court and the 62nd
12-4 District Court in Delta, Lamar, and Red River counties <County>.
12-5 Sec. 24.185. 83rd Judicial District (Brewster, Jeff Davis,
12-6 Pecos, and Presidio<, Reagan, and Upton> Counties). (a) The 83rd
12-7 Judicial District is composed of Brewster, Jeff Davis, Pecos, and
12-8 Presidio<, Reagan, and Upton> counties.
12-9 (b) The 83rd and 112th district courts have concurrent
12-10 jurisdiction in Pecos County <and Upton counties>.
12-11 (c) The terms of the 83rd District Court begin:
12-12 (1) in Brewster County on the fourth and 11th Mondays
12-13 after the first Mondays in January and July;
12-14 (2) in Jeff Davis County on the second Mondays in
12-15 January and July;
12-16 (3) in Pecos County on the ninth Monday after the
12-17 first Mondays in January and July; and
12-18 (4) in Presidio County on the third Monday after the
12-19 first Mondays in January and July<;>
12-20 <(5) in Reagan County on the 14th Monday after the
12-21 first Mondays in January and July; and>
12-22 <(6) in Upton County on the 12th Monday after the
12-23 first Mondays in January and July>.
12-24 (d) In <each of the counties of> Pecos County <and Upton>, a
12-25 petition or other pleading filed in the district courts is
12-26 sufficient if addressed "To The District Court of Pecos County,
12-27 Texas," <or "To The District Court of Upton County, Texas,"
13-1 respectively,> without giving the number of the district court in
13-2 the address.
13-3 Sec. 24.202. 100th Judicial District (<Carson,> Childress,
13-4 Collingsworth, Donley, and Hall Counties). (a) The 100th Judicial
13-5 District is composed of <Carson,> Childress, Collingsworth, Donley,
13-6 and Hall counties.
13-7 (b) The terms of the 100th District Court begin:
13-8 (1) <in Carson County on the first Mondays in January
13-9 and August;>
13-10 <(2)> in Childress County on the first Mondays in May
13-11 and December;
13-12 (2) <(3)> in Collingsworth County on the first Mondays
13-13 in April and November;
13-14 (3) <(4)> in Donley County on the first Mondays in
13-15 March and October; and
13-16 (4) <(5)> in Hall County on the first Mondays in
13-17 February and September.
13-18 (c) Each term provided by Subsection (b) begins at 10 a.m.
13-19 on the first day of the term.
13-20 Sec. 24.204. 102nd Judicial District (Bowie and Cass <Red
13-21 River> Counties). (a) The 102nd Judicial District is composed of
13-22 Bowie and Cass <Red River> counties.
13-23 (b) The terms of the 102nd District Court begin:
13-24 (1) in Bowie County on the first Mondays in January,
13-25 April, July, and October; and
13-26 (2) in Cass <Red River> County on the first Mondays in
13-27 January <February, May, August,> and July <November>.
14-1 (c) Section 24.105, relating to the 5th District Court,
14-2 contains provisions applicable to both that court and the 102nd
14-3 District Court in Bowie and Cass counties <County>.
14-4 <(d) Section 24.106, relating to the 6th District Court,
14-5 contains provisions applicable to both that court and the 102nd
14-6 District Court in Red River County.>
14-7 Sec. 24.216. 114th Judicial District (Smith County <and Wood
14-8 Counties>). (a) The 114th Judicial District is composed of Smith
14-9 County <and Wood counties>.
14-10 (b) The terms of the 114th District Court <in each county of
14-11 the district> begin on the first Mondays in January and July.
14-12 Sec. 24.253. 154th Judicial District (El Paso <Lamb>
14-13 County). (a) The 154th Judicial District is composed of El Paso
14-14 <Lamb> County.
14-15 (b) The terms of the 154th District Court begin on the first
14-16 Mondays in January and July and are designated as the January and
14-17 July terms.
14-18 Sec. 24.375. 196th Judicial District (Hunt and Rains
14-19 Counties <County>). The 196th Judicial District is composed of
14-20 Hunt and Rains counties <County>.
14-21 Sec. 24.384. 205th Judicial District (<Culberson,> El Paso
14-22 County<, and Hudspeth Counties>). (a) The 205th Judicial District
14-23 is composed of <Culberson,> El Paso County<, and Hudspeth
14-24 counties>.
14-25 (b) The 205th District Court shall give preference to
14-26 criminal cases.
14-27 (c) Section 24.136, relating to the 34th District Court,
15-1 contains provisions applicable to both that court and the 205th
15-2 District Court.
15-3 Sec. 24.389. 210th Judicial District (<Culberson,> El Paso
15-4 County<, and Hudspeth Counties>). (a) The 210th Judicial District
15-5 is composed of <Culberson,> El Paso County<, and Hudspeth
15-6 counties>.
15-7 (b) Section 24.136, relating to the 34th District Court,
15-8 contains provisions applicable to both that court and the 210th
15-9 District Court.
15-10 Sec. 24.430. 253rd Judicial District (<Chambers and> Liberty
15-11 County <Counties>). (a) The 253rd Judicial District is composed
15-12 of <Chambers and> Liberty County <counties>.
15-13 (b) The terms of the 253rd District Court begin <in Liberty
15-14 County> on the first Mondays in April and October <and in Chambers
15-15 County on the first Mondays in June and December>.
15-16 Sec. 24.451. 274th Judicial District (Caldwell, Comal,
15-17 <Guadalupe,> and Hays Counties). (a) The 274th Judicial District
15-18 is composed of Caldwell, Comal, <Guadalupe,> and Hays counties.
15-19 (b) The terms of the 274th District Court begin:
15-20 (1) <on the second Tuesdays in February and August> in
15-21 Caldwell County on the first Mondays in March, June, September, and
15-22 December;
15-23 (2) in <and> Comal County on the first Mondays in
15-24 April, July, October, and January; and
15-25 (3) <counties, on the second Tuesdays in May and
15-26 November in Guadalupe County, and on the second Tuesdays in June
15-27 and December> in Hays County on the first Mondays in February, May,
16-1 August, and November.
16-2 (c) The jurisdiction of the 274th District Court is
16-3 concurrent with the jurisdiction of the 22nd and the 207th district
16-4 courts in Caldwell, Comal, and Hays counties <and with the 25th and
16-5 Second 25th district courts in Guadalupe County>.
16-6 (d) Section 24.123, relating to the 22nd District Court,
16-7 contains provisions applicable to both that court and the 274th
16-8 District Court.
16-9 Sec. 24.453. 276th Judicial District (<Camp,> Marion,
16-10 Morris, and Titus Counties). (a) The 276th Judicial District is
16-11 composed of <Camp,> Marion, Morris, and Titus counties.
16-12 (b) The terms of the 276th District Court begin:
16-13 (1) in Marion County on the first Mondays in January,
16-14 May, and July;
16-15 (2) in Morris County on the first Mondays in February,
16-16 March, and September; and
16-17 (3) in Titus County on the first Mondays in April,
16-18 June, and November<; and>
16-19 <(4) in Camp County on the first Mondays in October
16-20 and December>.
16-21 (c) The jurisdiction of the 276th District Court is
16-22 concurrent with the jurisdiction of the 115th District Court in
16-23 Marion County and with the 76th District Court in <Camp,> Morris<,>
16-24 and Titus counties.
16-25 (d) The 276th District Court has concurrent jurisdiction
16-26 with the county courts in <Camp,> Marion<,> and Morris counties
16-27 over all matters of criminal jurisdiction, original and appellate,
17-1 in cases over which the particular county court has jurisdiction
17-2 under the constitution and laws of this state. In each of the
17-3 counties, matters and proceedings in the concurrent jurisdiction
17-4 may be transferred between the 276th District Court and the county
17-5 court.
17-6 (e) Section 24.178, relating to the 76th District Court, has
17-7 provisions applicable to both that court and the 276th District
17-8 Court.
17-9 Sec. 24.464. 287th Judicial District (Bailey, Lamb, and
17-10 Parmer Counties). (a) The 287th Judicial District is composed of
17-11 Bailey, Lamb, and Parmer counties.
17-12 (b) The terms of the 287th District Court begin:
17-13 (1) in Bailey County on the first Mondays in February
17-14 and August;

17-16 July; and
17-17 (3) in Parmer County on the first Mondays in March and
17-18 September.
17-19 Sec. 24.624. 316th Judicial District (Carson and Hutchinson
17-20 Counties <County>). The 316th Judicial District is composed of
17-21 Carson and Hutchinson counties <County>.
17-22 SECTION 2. This Act takes effect September 1, 1995.
17-23 SECTION 3. The importance of this legislation and the
17-24 crowded condition of the calendars in both houses create an
17-25 emergency and an imperative public necessity that the
17-26 constitutional rule requiring bills to be read on three several
17-27 days in each house be suspended, and this rule is hereby suspended.
