No. 2522 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to participation in benefits from the Employees Retirement 1-3 System of Texas for certain law enforcement and custodial officers. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 811.001(9), Government Code, is amended 1-6 to read as follows: 1-7 (9) "Law enforcement officer" means a member of the 1-8 retirement system who has been commissioned as a law enforcement 1-9 officer by the Department of Public Safety, the Texas Alcoholic 1-10 Beverage Commission, the State Purchasing and General Services 1-11 Commission, Capitol Area Security Force, the State Board of 1-12 Pharmacy, or the Parks and Wildlife Department and who is 1-13 recognized as a commissioned law enforcement officer by the 1-14 Commission on Law Enforcement Officer Standards and Education. 1-15 SECTION 2. Section 814.104(b), Government Code, is amended 1-16 to read as follows: 1-17 (b) A member who is at least 55 years old and who has at 1-18 least 10 years of service credit as a commissioned peace officer 1-19 engaged in criminal law enforcement activities of the Department of 1-20 Public Safety, the Texas Alcoholic Beverage Commission, the State 1-21 Purchasing and General Services Commission Capitol Area Security 1-22 Force, the State Board of Pharmacy, or the Parks and Wildlife 1-23 Department, or as a custodial officer, is eligible to retire and 2-1 receive a service retirement annuity. 2-2 SECTION 3. Section 815.505, Government Code, is amended to 2-3 read as follows: 2-4 Sec. 815.505. Certification of Names of Law Enforcement and 2-5 Custodial Officers. Not later than the 12th day of the month 2-6 following the month in which a person begins or ceases employment 2-7 as a law enforcement officer or custodial officer, the Public 2-8 Safety Commission, the Texas Alcoholic Beverage Commission, the 2-9 Parks and Wildlife Commission, the State Board of Pharmacy, or the 2-10 Texas Board of Criminal Justice, as applicable, shall certify to 2-11 the retirement system, in the manner prescribed by the system, the 2-12 name of the employee and such other information as the system 2-13 determines is necessary for the crediting of service and financing 2-14 of benefits under this subtitle. 2-15 SECTION 4. Section 27, Chapter 791, Acts of the 73rd 2-16 Legislature, 1993, is amended to read as follows: 2-17 Sec. 27. Before October 1, 1995, the Public Safety 2-18 Commission, the Texas Alcoholic Beverage Commission, the Parks and 2-19 Wildlife Commission, the State Board of Pharmacy, and the Texas 2-20 Board of Criminal Justice shall certify to the Employees Retirement 2-21 System of Texas, in the manner prescribed by the retirement system, 2-22 the name of each person employed on September 1, 1995, by the 2-23 particular agency as a law enforcement officer, as defined by 2-24 Section 811.001, Government Code, or a custodial officer, as 2-25 defined by that section, and such other information as the system 3-1 determines is necessary for the crediting of service and financing 3-2 of benefits under Subtitle B, Title 8, Government Code. 3-3 SECTION 5. This Act takes effect September 1, 1995. 3-4 SECTION 6. The importance of this legislation and the 3-5 crowded condition of the calendars in both houses create an 3-6 emergency and an imperative public necessity that the 3-7 constitutional rule requiring bills to be read on three several 3-8 days in each house be suspended, and this rule is hereby suspended.
