    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to participation in benefits from the Employees Retirement
    1-9  System of Texas for certain law enforcement and custodial officers.
   1-10        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-11        SECTION 1.  Section 811.001(9), Government Code, is amended
   1-12  to read as follows:
   1-13              (9)  "Law enforcement officer" means a member of the
   1-14  retirement system who has been commissioned as a law enforcement
   1-15  officer by the Department of Public Safety, the Texas Alcoholic
   1-16  Beverage Commission, the State Purchasing and General Services
   1-17  Commission, Capitol Area Security Force, the State Board of
   1-18  Pharmacy, or the Parks and Wildlife Department and who is
   1-19  recognized as a commissioned law enforcement officer by the
   1-20  Commission on Law Enforcement Officer Standards and Education.
   1-21        SECTION 2.  Section 814.104(b), Government Code, is amended
   1-22  to read as follows:
   1-23        (b)  A member who is at least 55 years old and who has at
   1-24  least 10 years of service credit as a commissioned peace officer
   1-25  engaged in criminal law enforcement activities of the Department of
   1-26  Public Safety, the Texas Alcoholic Beverage Commission, the State
   1-27  Purchasing and General Services Commission Capitol Area Security
   1-28  Force, the State Board of Pharmacy, or the Parks and Wildlife
   1-29  Department, or as a custodial officer, is eligible to retire and
   1-30  receive a service retirement annuity.
   1-31        SECTION 3.  Section 815.505, Government Code, is amended to
   1-32  read as follows:
   1-33        Sec. 815.505.  Certification of Names of Law Enforcement and
   1-34  Custodial Officers.  Not later than the 12th day of the month
   1-35  following the month in which a person begins or ceases employment
   1-36  as a law enforcement officer or custodial officer, the Public
   1-37  Safety Commission, the Texas Alcoholic Beverage Commission, the
   1-38  Parks and Wildlife Commission, the State Board of Pharmacy, or the
   1-39  Texas Board of Criminal Justice, as applicable, shall certify to
   1-40  the retirement system, in the manner prescribed by the system, the
   1-41  name of the employee and such other information as the system
   1-42  determines is necessary for the crediting of service and financing
   1-43  of benefits under this subtitle.
   1-44        SECTION 4.  Section 27, Chapter 791, Acts of the 73rd
   1-45  Legislature, 1993, is amended to read as follows:
   1-46        Sec. 27.  Before October 1, 1995, the Public Safety
   1-47  Commission, the Texas Alcoholic Beverage Commission, the Parks and
   1-48  Wildlife Commission, the State Board of Pharmacy, and the Texas
   1-49  Board of Criminal Justice shall certify to the Employees Retirement
   1-50  System of Texas, in the manner prescribed by the retirement system,
   1-51  the name of each person employed on September 1, 1995, by the
   1-52  particular agency as a law enforcement officer, as defined by
   1-53  Section 811.001, Government Code, or a custodial officer, as
   1-54  defined by that section, and such other information as the system
   1-55  determines is necessary for the crediting of service and financing
   1-56  of benefits under Subtitle B, Title 8, Government Code.
   1-57        SECTION 5.  This Act takes effect September 1, 1995.
   1-58        SECTION 6.  The importance of this legislation and the
   1-59  crowded condition of the calendars in both houses create an
   1-60  emergency and an imperative public necessity that the
   1-61  constitutional rule requiring bills to be read on three several
   1-62  days in each house be suspended, and this rule is hereby suspended.
