A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to fees collected and deposited into the clean air fund,
1-3 and the creation of the salvage and repair fund.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 382.0622, Health and Safety Code, is
1-6 amended by amending Subsection (a) to read as follows:
1-7 (a) Clean Air Act fees consist of:
1-8 (1) fees collected by the board under Sections
1-9 382.062, 382.0621<, and 382.037 and as otherwise provided by law;
1-10 and>
1-11 <(2) $2 of each advance payment collected by the
1-12 Department of Public Safety for inspection certificates for
1-13 vehicles other than mopeds under Section 141(c), Uniform Act
1-14 Regulating Traffic on Highways (Article 6701d, Vernon's Texas Civil
1-15 Statutes).>
1-16 SECTION 2. Subchapter B, Chapter 328, Health and Safety Code
1-17 is amended by adding Subsection 382.0623 to read as follows:
1-18 Sec. 382.0623. VEHICLE MAINTENANCE FEES. (a) Vehicle
1-19 maintenance fees consist of:
1-20 (1) fees collected by the board under Section 382.037
1-21 and as otherwise provided by law; and
1-22 (2) $2 of each advance payment collected by the
1-23 Department of Public Safety for inspection certificates for
2-1 vehicles other than mopeds under Section 141(c), Uniform Act
2-2 Regulating Traffic on Highways (Article 6701d, Vernon's Texas Civil
2-3 Statutes).
2-4 (b) Vehicle maintenance fees shall be deposited in the state
2-5 treasury to the credit of the repair and salvage fund and shall be
2-6 used for the salvage and repair of vehicles identified through the
2-7 vehicle emissions inspection and maintenance program under Section
2-8 142, Uniform Act Regulating Traffic on Highways (Article 6701d,
2-9 Vernon's Texas Civil Statutes).
2-10 (c) The board shall request the appropriation of sufficient
2-11 money to salvage and repair vehicles, including payments to the
2-12 Public Safety Commission for incidental costs of administering the
2-13 vehicle emissions inspection and maintenance program, except that
2-14 after the date of delegation of the state's permitting program
2-15 under Title V of the federal Clean Air Act (42 U.S.C. Sections
2-16 7661 et seq.), fees collected under Section 382.0621(a) may be
2-17 appropriated only to cover costs of developing and administering a
2-18 program to salvage and repair vehicles under Section 142, Uniform
2-19 Act Regulating Traffic on Highways (Article 6701d, Vernon's Texas
2-20 Civil Statutes).
2-21 SECTION 3. Chapter 564, Section 2.01, Acts 1993, 73rd
2-22 legislature is amended by adding Subsection (15) to read as
2-23 follows:
2-24 (15) salvage and repair fund authorized under Section
2-25 382.0623, Health and Safety Code.
3-1 SECTION 4. Chapter 685, Section 23.01, Acts 1993, 73rd
3-2 legislature is amended by adding Subsection (15) to read as
3-3 follows:
3-4 (15) salvage and repair fund authorized under Section
3-5 382.0623, Health and Safety Code.
3-6 SECTION 5. This Act takes effect September 1, 1995.
3-7 SECTION 6. The importance of this legislation and the
3-8 crowded condition of the calendars in both houses create an
3-9 emergency and an imperative public necessity that the
3-10 constitutional rule requiring bills to be read on three several
3-11 days in each house be suspended, and this rule is hereby suspended.
