No. 2547 74R6952 KLL-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the establishment of cemeteries in or near the 1-3 boundaries of municipalities. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 711.008, Health and Safety Code, is 1-6 amended by amending Subsection (a) and adding Subsection (f) to 1-7 read as follows: 1-8 (a) Except as provided by Subsections (b), (c), (f), and 1-9 (k), an individual, corporation, partnership, firm, trust, or 1-10 association may not establish or operate a cemetery, or use any 1-11 land for the interment of remains, located: 1-12 (1) in or within one mile of the boundaries of a 1-13 municipality with a population of 5,000 to 25,000; 1-14 (2) in or within two miles of the boundaries of a 1-15 municipality with a population of 25,000 to 50,000; 1-16 (3) in or within three miles of the boundaries of a 1-17 municipality with a population of 50,000 to 100,000; 1-18 (4) in or within four miles of the boundaries of a 1-19 municipality with a population of 100,000 to 200,000; or 1-20 (5) in or within five miles of the boundaries of a 1-21 municipality with a population of at least 200,000. 1-22 (f) Subsection (a) does not apply to the establishment of a 1-23 cemetery if it is located adjacent but not necessarily contiguous 1-24 to a cemetery that is authorized to acquire additional land under 2-1 Subsection (c). 2-2 SECTION 2. The importance of this legislation and the 2-3 crowded condition of the calendars in both houses create an 2-4 emergency and an imperative public necessity that the 2-5 constitutional rule requiring bills to be read on three several 2-6 days in each house be suspended, and this rule is hereby suspended, 2-7 and that this Act take effect and be in force from and after its 2-8 passage, and it is so enacted.
