                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the establishment of a program to facilitate resolution
    1-3  of policy holder complaints.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Article 1.04B of the Texas Insurance Code is
    1-6  amended by striking the current provision in its entirety and
    1-7  substituting therefor the following:
    1-8        "The department shall establish a program to facilitate
    1-9  resolution of policy holder complaints.  However, no examination
   1-10  under any article of this Code shall be ordered by reason of such
   1-11  complaint, unless the insurance organization is given notice of
   1-12  such complaint, and given thirty (30) days from the date of such
   1-13  notice to resolve the complaint to the satisfaction of the
   1-14  complainant."
   1-15        SECTION 2.  This Act takes effect September 1, 1995.
   1-16        SECTION 3.  The importance of this legislation and the
   1-17  crowded condition of the calendars in both houses create an
   1-18  emergency and an imperative public necessity that the
   1-19  constitutional rules requiring bills to be read on three several
   1-20  days in each house be suspended, and this rule is hereby suspended.
