A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to incentive programs to minimize the use of the Texas
1-3 Automobile Insurance Plan Association.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subsection (e), Section 3, Article 21.81, Texas
1-6 Insurance Code, is amended to read as follows:
1-7 (e) Among other provisions, the plan of operation must
1-8 contain incentive programs to encourage members to write insurance
1-9 on a voluntary basis and to minimize the use of the association as
1-10 a means to obtain insurance. The incentive programs are effective
1-11 on approval of the commissioner. <One of these programs shall>
1-12 Among such approved incentive programs shall be those that
1-13 recognize the voluntary writing of bodily injury and property
1-14 damage liability insurance for male vehicle operators under 25
1-15 years of age, for all vehicle operators 65 years of age or older,
1-16 and for vehicle operators in <target> underserved geographic areas
1-17 which shall be determined and designated by the commissioner by
1-18 rule. In determining which areas will be designated as
1-19 underserved, the commissioner shall consider the availability of
1-20 insurance, the number of uninsured drivers, the number of drivers
1-21 insured through the association, and any other relevant factor.
1-22 SECTION 2. The importance of this legislation and the
1-23 crowded condition of the calendars in both houses create an
2-1 emergency and an imperative public necessity that the
2-2 constitutional rule requiring bills to be read on three several
2-3 days in each house be suspended, and this rule is hereby suspended.
