                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the licensing and regulation of the practice of art
    1-3  therapy; providing a penalty
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  SCOPE OF ACT, ELIGIBILITY.  This Act only applies
    1-6  to a person who represents himself as a "registered art therapist"
    1-7  or an "art therapy intern" within the meaning of this Act,
    1-8  qualifies as a registered art therapist or art therapy intern as
    1-9  defined in this act, possesses the education and training required
   1-10  under Section 3 of this Act, and only to the extent the person is
   1-11  engaged in the practice of art therapy as defined in this act.
   1-12        SECTION 2.  DEFINITIONS.  In this Act:
   1-13              (1)  "Registered art therapist" means a person who has
   1-14  the authority to engage in the autonomous practice of art therapy
   1-15  and who represents himself or herself to the public by any title or
   1-16  description of services incorporating the words "art therapist,"
   1-17  who offers to render professional art therapy services to
   1-18  individuals, couples, families, groups, organizations,
   1-19  corporations, institutions, government agencies, or the general
   1-20  public for compensation, implying that he or she is registered and
   1-21  trained, experienced, or expert in art therapy, and who is a
   1-22  registered art therapist through the American Art Therapy
   1-23  Association and may use the title "A.T.R." in the practice of art
   1-24  therapy.
    2-1              (2)  "Art therapy intern" means a person who has
    2-2  completed the education requirements and has entered into a
    2-3  supervisory agreement with a registered art therapist to prepare
    2-4  for registration under Section 3 of this Act.
    2-5              (3)  "Practice of art therapy" means the rendering to
    2-6  individuals, families, or groups of services that use art media as
    2-7  a means of expression and communication to promote perceptive,
    2-8  intuitive, affective, and expressive experiences that alleviate
    2-9  distress, reduce physical, emotional, behavorial, and social
   2-10  impairment and lead to growth or reintegration of one's
   2-11  personality.   Art therapy services include diagnostic evaluation,
   2-12  development of patient treatment plans, goals and objectives, case
   2-13  management services, therapeutic treatment and referral, but does
   2-14  not include the use of projective techniques in the assessment of
   2-15  personality.
   2-16        SECTION 3.  EDUCATION AND TRAINING.  (a)  To qualify as a
   2-17  registered art therapist or an art therapy intern under this Act, a
   2-18  person must have completed, as a minimum,
   2-19              (1)  a master's or doctoral degree in art therapy that
   2-20  includes 600 hours of supervised internship experience from a
   2-21  program accredited through the American Art Therapy Association; or
   2-22              (2)  a master's degree in a counseling related field, a
   2-23  minimum of 21 semester hours of sequential course work in the
   2-24  history, theory, and practice of art therapy, and 600 hours of
   2-25  supervised internship experience from a program accredited through
   2-26  the American Art Therapy Association.
   2-27        (b)  To qualify as a registered art therapist under this Act.
    3-1  a person must have completed an additional 1,000 client contact
    3-2  hours of postgraduate experience under supervision of a
    3-3  psychiatrist, psychologist, social worker, licensed professional
    3-4  counselor, or nationally registered art therapist, beyond the
    3-5  requirements in subsection (a)(1) of this section; or 2,000 client
    3-6  contact hours of postgraduate experience under supervision of a
    3-7  psychiatrist, psychologist, social worker, licensed professional
    3-8  counselor, or nationally registered art therapist beyond the
    3-9  requirements in subsection (a)(2) of this section.
   3-10        SECTION 4.  EXEMPTIONS.  A person who is a registered art
   3-11  therapist or an art therapy intern as defined in this Act and is
   3-12  engaged in the practice of art therapy as defined in and under the
   3-13  limitations imposed by this Act is exempt from the licensing
   3-14  requirements contained in Sections 21 and 22 of Article 4512c,
   3-15  Vernon's Texas Civil Statutes, and Section 15 of Article 4512g,
   3-16  Vernon's Texas Civil Statutes, only with respect to the practice of
   3-17  art therapy, until January 1, 1998.
   3-18        SECTION 5.  EXPIRATION.  This Act expires on January 1, 1998.
   3-19        SECTION 6.  EFFECTIVE DATE.  This Act takes effect on
   3-20  September 1, 1995.
   3-21        SECTION 7.  EMERGENCY.  The importance of this legislation
   3-22  and the crowded condition of the calendars in both houses create an
   3-23  emergency and an imperative public necessity that the
   3-24  constitutional rule requiring bills to be read on three separate
   3-25  days in each house be suspended, and this rule is hereby suspended.
