No. 2738 74R7714 GCH-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to service credit in retirement systems for police 1-3 officers in certain municipalities. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Article 6243g-3, Revised Statutes, is amended by 1-6 adding Section 25B to read as follows: 1-7 Sec. 25B. CREDIT FOR MEMBER TRANSFERRED BY CITY. (a) A 1-8 member covered by the plan provisions of this article who has been 1-9 transferred by action of a city to which this article applies to a 1-10 classified position in a police department included in the pension 1-11 system is entitled to service credit in the pension system for the 1-12 member's previous service credited under Chapter 358, Acts of the 1-13 48th Legislature, 1943 (Article 6243g, Vernon's Texas Civil 1-14 Statutes), if the member has not retired under that Act or this 1-15 article. 1-16 (b) If a member applies for service credit under this 1-17 section, the pension system governed by Chapter 358, Acts of the 1-18 48th Legislature, 1943 (Article 6243g, Vernon's Texas Civil 1-19 Statutes), to which the city that transferred the employee 1-20 contributes shall certify to this pension system the dates and 1-21 amount of the member's service, the amounts of the member's salary 1-22 during the period of service, and the amounts contributed by the 1-23 city and the member for the service and shall transfer to this 1-24 pension system an amount equal to the amounts contributed by the 2-1 city for the service and the amounts, if any, contributed by the 2-2 member for the service, unless the member has withdrawn 2-3 contributions made under that pension system. A certification and 2-4 transfer under this subsection cancels the credited service in the 2-5 pension system governed by Chapter 358, Acts of the 48th 2-6 Legislature, 1943 (Article 6243g, Vernon's Texas Civil Statutes). 2-7 If the member withdrew contributions from the member's former 2-8 pension system, the member must deposit the amount withdrawn to 2-9 receive service credit under this section. On payment of the 2-10 amounts required by this subsection, this pension system shall 2-11 grant the member credit for the certified amount of service. 2-12 SECTION 2. The importance of this legislation and the 2-13 crowded condition of the calendars in both houses create an 2-14 emergency and an imperative public necessity that the 2-15 constitutional rule requiring bills to be read on three several 2-16 days in each house be suspended, and this rule is hereby suspended, 2-17 and that this Act take effect and be in force from and after its 2-18 passage, and it is so enacted.
