No. 2754 By: Gallegos 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to transportation of portable building units. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Article 6701a-2, Revised Statutes, is amended by 1-13 adding Sections H, I, and J to read as follows: 1-14 H.(a) A portable building unit that exceeds 16 feet, but is 1-15 not more than 18 feet, in width must have one escort flag vehicle 1-16 that must: 1-17 (1) precede the portable building unit on a two-lane 1-18 roadway; or 1-19 (2) follow the portable building unit on a roadway of 1-20 four or more lanes. 1-21 (b) A portable building unit that exceeds 18 feet in width 1-22 must be preceded and followed by escort flag vehicles while moving 1-23 over a highway, road, or street in this state. 1-24 (c) An escort flag vehicle must have: 1-25 (1) on top of the vehicle and visible from the front 1-26 and rear: 1-27 (A) two lights flashing simultaneously; or 1-28 (B) one rotating amber beacon of not less than 1-29 eight inches; 1-30 (2) four red 16-inch square flags mounted on the four 1-31 corners of the vehicle so that one flag is on each corner; and 1-32 (3) signs that: 1-33 (A) are mounted on the front and rear of the 1-34 vehicle; and 1-35 (B) have a yellow background and black letters 1-36 at least eight inches high stating "wide load." 1-37 I. This article applies to transportation of a portable 1-38 building unit regardless of whether it is transported as an 1-39 assembled or partially assembled portable building or as 1-40 unassembled modular building components. 1-41 J. In this article, "portable building unit" means 1-42 prefabricated structural and other modular components that 1-43 constitute a complete portable building bearing a single distinct 1-44 serial number when assembled. 1-45 SECTION 2. This Act takes effect September 1, 1995. 1-46 SECTION 3. The importance of this legislation and the 1-47 crowded condition of the calendars in both houses create an 1-48 emergency and an imperative public necessity that the 1-49 constitutional rule requiring bills to be read on three several 1-50 days in each house be suspended, and this rule is hereby suspended. 1-51 * * * * *
