                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the sale of articles or products manufactured in a
    1-3  correctional facility.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 497.035(a), Government Code, is amended
    1-6  to read as follows:
    1-7        (a)  A person commits an offense if the person intentionally
    1-8  sells or offers to sell on the open market in this state an article
    1-9  or product the person knows was manufactured in whole or in part by
   1-10  an inmate of the institutional division or an inmate in a
   1-11  correctional facility in any other state, other than an inmate:
   1-12              (1)  who was on community supervision, <probation or>
   1-13  parole, or mandatory supervision;
   1-14              (2)  <or> employed by an enterprise who has employed
   1-15  the inmate to advantage themselves of the Franchise Tax Credit
   1-16  offered under Subchapter L, Chapter 171, Tax Code, at the time of
   1-17  manufacture; or
   1-18              (3)  participating in a federally certified prison
   1-19  industry enhancement program.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
