                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to requiring a defendant convicted of an offense causing a
    1-3  death to pay child support as restitution for the offense.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subsection (b)(3), Article 42.037, Code of
    1-6  Criminal Procedure, is amended to read as follows:
    1-7              (3)  If the offense results in the death of a victim,
    1-8  the court may, in addition to an order under Subdivision (2) of
    1-9  this subsection, order the defendant to pay:
   1-10                    (A)  an amount equal to the cost of necessary
   1-11  funeral and related services; and
   1-12                    (B)  if the victim is survived by a minor child,
   1-13  child support for that child in the same amount as if the defendant
   1-14  were the parent of the child and were required to pay child support
   1-15  for the child in a suit affecting the parent-child relationship.
   1-16        SECTION 2.  This Act takes effect September 1, 1995.
   1-17        SECTION 3.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended.
