                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the sale of a lottery ticket from a vending machine.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 466.253, Government Code, is amended by
    1-5  adding Subsections (c), (d), (e), and (f) to read as follows:
    1-6        (c)  A sales agent or an employee of a sales agent may not
    1-7  use a vending machine to sell or to offer to sell a lottery ticket
    1-8  if any individual under 18 years of age may:
    1-9              (1)  enter the room where the vending machine is
   1-10  located; or
   1-11              (2)  otherwise obtain access to the vending machine.
   1-12        (d)  Each person who sells lottery tickets by vending machine
   1-13  shall post a sign in a location that is conspicuous to all
   1-14  employees and customers and that is close to the place at which the
   1-15  lottery tickets may be purchased.
   1-16        (e)  The sign must include the statement: "SALE OF A LOTTERY
   1-17  TICKET TO A PERSON UNDER 18 YEARS OF AGE IS PROHIBITED BY LAW."
   1-18        (f)  The commission by rule shall determine the design and
   1-19  size of the sign.
   1-20        SECTION 2.  This Act takes effect September 1, 1995.
   1-21        SECTION 3.  Sections 466.253(c), (d), (e), and (f),
   1-22  Government Code, as amended by this Act, apply only to the sale of
   1-23  a lottery ticket that occurs on or after the effective date of this
   1-24  Act.  The sale of a lottery ticket that occurs before the effective
    2-1  date of this Act is governed by the law in effect on the date of
    2-2  the sale, and the former law is continued in effect for that
    2-3  purpose.
    2-4        SECTION 4.  The importance of this legislation and the
    2-5  crowded condition of the calendars in both houses create an
    2-6  emergency and an imperative public necessity that the
    2-7  constitutional rule requiring bills to be read on three several
    2-8  days in each house be suspended, and this rule is hereby suspended.
