                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the appointment of bailiffs by certain judges.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 53.002, Government Code, is amended by
    1-5  adding Subsection (f) to read as follows:
    1-6        (f)  The judges of the 9th, 2nd 9th, 221st, 359th, and 284th
    1-7  District Courts and the judges of the statutory county courts in
    1-8  Montgomery County may each appoint a bailiff.  A bailiff for a
    1-9  district court that is composed of more than one county may, at the
   1-10  discretion of the judge, serve the court in each county of the
   1-11  district.
   1-12        SECTION 2.  Section 53.006(a), Government Code, is amended by
   1-13  as follows:
   1-14        (a)  A bailiff or grand jury bailiff appointed under Section
   1-15  53.001, 53.002(a), 53.002(c), 53.002(d), 53.002(e), or 53.002(f) is
   1-16  an officer of the court.
   1-17        SECTION 3.  Section 53.009, Government code, is amended by
   1-18  adding Subsection (k) to read as follows:
   1-19        (k)  Each bailiff appointed under Section 53.002(f) is
   1-20  entitled to receive a salary set by the judge.  The salary is paid
   1-21  out of the general fund of the county.
   1-22        SECTION 4.  This Act takes effect September 1, 1995.
   1-23        SECTION 5.  The importance of this legislation and the crowed
    2-1  condition of the calendars in both houses create an emergency and
    2-2  an imperative public necessity that the constitutional rule
    2-3  requiring bills too be read on three several days in each house be
    2-4  suspended, and this rule is hereby suspended.
