                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the vehicle inspection and maintenance program.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 382.037, Health & Safety Code, is amended
    1-5  by adding Subsection (c) to read as follows:
    1-6        (c)  If the program is established under this section, the
    1-7  board:
    1-8              (1)  shall adopt vehicle emissions inspection and
    1-9  maintenance requirements for certain areas as required by federal
   1-10  law or regulation; and
   1-11              (2)  may adopt vehicle emissions inspection and
   1-12  maintenance requirements for counties not subject to a specific
   1-13  federal requirement in response to a formal request by resolutions
   1-14  adopted by the county and the most populous municipality within the
   1-15  county according to the most recent federal decennial census.
   1-16              (3)  may not establish a centralized vehicle inspection
   1-17  and maintenance program for any class of vehicles unless
   1-18  specifically authorized by the legislature.
   1-19        SECTION 3.  Section 382.038, Health & Safety Code, is amended
   1-20  by amending Subsection (c) to read as follows:
   1-21        (b)  A vehicle emissions inspection shall <may> be performed
   1-22  at a decentralized independent inspection station or at a
   1-23  decentralized <centralized> inspection facility operated or
    2-1  licensed by the state.  In developing the program for vehicle
    2-2  emissions inspections, the board shall make all reasonable efforts
    2-3  to preserve the present decentralized system.
    2-4        SECTION 3.  This Act takes effect September 1, 1995.
    2-5        SECTION 4.  The importance of this legislation and the
    2-6  crowded condition of the calendars in both houses create an
    2-7  emergency and an imperative public necessity that the
    2-8  constitutional rule requiring bills to be read on three several
    2-9  days in each house be suspended, and this rule is hereby suspended.
