    1-1                                AN ACT
    1-2  relating to eligibility for disability pensions from retirement
    1-3  systems for police officers in certain municipalities.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 13, Article 6243g-3, Revised Statutes, is
    1-6  amended to read as follows:
    1-7        Sec. 13.  ELIGIBILITY FOR DISABILITY PENSION.  (a)  A
    1-8  member<, not otherwise eligible for a service pension,> who suffers
    1-9  a partial or total disability resulting from an individual and
   1-10  specific act the type of which would normally occur while employed
   1-11  as a police officer, shall be eligible for a duty-connected
   1-12  disability pension.  If such act involves a traumatic event which
   1-13  directly causes an immediate cardiovascular condition which results
   1-14  in partial or total disability, the member shall be eligible for a
   1-15  partial or total duty-connected disability pension.
   1-16        (b)  A member<, not otherwise eligible for a service
   1-17  pension,> with 10 years of credited service who suffers a partial
   1-18  or total disability and who is not eligible for a duty-connected
   1-19  disability pension shall be eligible for an ordinary partial or
   1-20  total disability pension.
   1-21        (c)  The determination of disability and its cause shall be
   1-22  made by the board after receiving the recommendation of a physician
   1-23  or physicians of its choice.
   1-24        SECTION 2.  The importance of this legislation and the
    2-1  crowded condition of the calendars in both houses create an
    2-2  emergency and an imperative public necessity that the
    2-3  constitutional rule requiring bills to be read on three several
    2-4  days in each house be suspended, and this rule is hereby suspended.
