A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to eligibility for disability pensions from retirement
1-3 systems for police officers in certain municipalities.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 13, Article 6243g-3, Revised Statutes, is
1-6 amended to read as follows:
1-7 Sec. 13. (a) A member<, not otherwise eligible for a
1-8 service pension,> who suffers a partial or total disability
1-9 resulting from an individual and specific act the type of which
1-10 would normally occur while employed as a police officer, shall be
1-11 eligible for a duty-connected disability pension. If such act
1-12 involves a traumatic event which directly causes an immediate
1-13 cardiovascular condition which results in partial or total
1-14 disability, the member shall be eligible for a partial or total
1-15 duty-connected disability pension.
1-16 (b) A member<, not otherwise eligible for a service
1-17 pension,> with 10 years of credited service who suffers a partial
1-18 or total disability and who is not eligible for a duty-connected
1-19 disability pension shall be eligible for an ordinary partial or
1-20 total disability pension.
1-21 (c) The determination of disability and its cause shall be
1-22 made by the board after receiving the recommendation of a physician
1-23 or physicians of its choice.
1-24 SECTION 2. The importance of this legislation and the
2-1 crowded condition of the calendars in both houses create an
2-2 emergency and an imperative public necessity that the
2-3 constitutional rule requiring bills to be read on three several
2-4 days in each house be suspended, and this rule is hereby suspended.
