No. 2898 1-2 (In the Senate - Received from the House May 8, 1995; 1-3 May 9, 1995, read first time and referred to Committee on Health 1-4 and Human Services; May 23, 1995, reported favorably by the 1-5 following vote: Yeas 5, Nays 0; May 23, 1995, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the inspection and maintenance of dental X-ray 1-9 equipment. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Chapter 9, Title 71, Revised Statutes, is amended 1-12 by adding Article 4551o to read as follows: 1-13 Art. 4551o. A dentist may authorize a qualified person to 1-14 perform beam calibration and characterization, quality assurance, 1-15 instrument specification, acceptance testing, shielding design, or 1-16 protection analysis on radiation-emitting equipment or 1-17 radiopharmaceuticals for procedures involved with the diagnosis or 1-18 treatment of disease or other dental conditions in humans. The 1-19 authorization of such acts by a dentist and the performance of same 1-20 by a qualified person shall not constitute the practice of medical 1-21 physics as defined and regulated by Article 4512n, Revised 1-22 Statutes. 1-23 SECTION 2. This Act takes effect on September 1, 1995. 1-24 SECTION 3. The importance of this legislation and the 1-25 crowded condition of the calendars in both houses create an 1-26 emergency and an imperative public necessity that the 1-27 constitutional rule requiring bills to be read on three several 1-28 days in each house be suspended, and this rule is hereby suspended. 1-29 * * * * *
