By Allen H.B. No. 2910 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to certain criminal background checks regarding applicants 1-3 for and holders of certain persons under the Private Investigators 1-4 and Private Security Agencies Act. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Section 411.119, Government Code, is amended to 1-7 read as follows: 1-8 Sec. 411.119. Access to Criminal History Record Information: 1-9 Texas Board of Private Investigators and Private Security Agencies. 1-10 (a) The Texas Board of Private Investigators and Private Security 1-11 Agencies is entitled to obtain from the department criminal history 1-12 record information maintained by the department that relates to a 1-13 person who is: 1-14 (1) an applicant for a license, registration, or 1-15 security officer commission under the Private Investigators and 1-16 Private Security Agencies Act (Article 4413(29bb), Vernon's Texas 1-17 Civil Statutes); (or) 1-18 (2) an applicant for a position regulated under that 1-19 Act; or 1-20 (3) the holder of a license under that Act. 1-21 (b) In addition to information obtained from the Federal 1-22 Bureau of Investigation under Section 411.087, the Texas Board of 1-23 Private Investigators and Private Security Agencies is entitled to 2-1 obtain information relating to the wanted persons status of a 2-2 license applicant or license holder. 2-3 SECTION 2. Subchapter F, Chapter 411, Government Code, is 2-4 amended by adding Section 411.1195 to read as follows: 2-5 Sec. 411.1195. ACCESS TO CRIMINAL HISTORY RECORD 2-6 INFORMATION: PERSONS WHO EMPLOY PRIVATE INVESTIGATORS AND PRIVATE 2-7 SECURITY OFFICERS. (a) The governing body of a business entity 2-8 that employs a person licensed or registered by the Texas Board of 2-9 Private Investigators and Private Security Agencies is entitled to 2-10 obtain from the department criminal history record information 2-11 maintained by the department that relates to a person who is: 2-12 (1) an applicant for a license, registration, or 2-13 security officer commission under the Private Investigators and 2-14 Private Security Agencies Act (Article 4413(29bb), Vernon's Texas 2-15 Civil Statutes); or 2-16 (2) an employee who holds a license issued under that 2-17 Act. 2-18 (b) In addition to information obtained from the Federal 2-19 Bureau of Investigation under Section 411.087, the governing body 2-20 of the business entity is entitled to obtain information relating 2-21 to the wanted persons status of an individual described by 2-22 Subsection (a)(1) or (2). 2-23 SECTION 2. The importance of this legislation and the 2-24 crowded condition of the calendars in both houses create an 2-25 emergency and an imperative public necessity that the 3-1 constitutional rule requiring bills to be read on three several 3-2 days in each house be suspended, and this rule is hereby suspended, 3-3 and that this Act take effect and be in force from and after its 3-4 passage, and it is so enacted.
