No. 2923 74R7758 JJT-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to establishing a community-based treatment program for 1-3 certain dually diagnosed children in a region bordering Mexico. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter B, Chapter 533, Health and Safety 1-6 Code, is amended by adding Section 533.0355 to read as follows: 1-7 Sec. 533.0355. COMMUNITY-BASED TREATMENT FOR CERTAIN 1-8 CHILDREN WITH SUBSTANCE ABUSE TREATMENT NEEDS. (a) The department 1-9 and the Texas Commission on Alcohol and Drug Abuse jointly shall 1-10 contract with a mental health and mental retardation authority 1-11 described by Subsection (b) to establish a treatment program for 1-12 children who are diagnosed as having treatment needs for: 1-13 (1) substance abuse; and 1-14 (2) mental illness or mental retardation. 1-15 (b) The contract must be with a mental health and mental 1-16 retardation authority whose jurisdiction includes a county that 1-17 shares a border with the United Mexican States and has a population 1-18 of more than 375,000. 1-19 (c) The contract must require that the program be located in 1-20 a treatment facility operated by a community center and located in: 1-21 (1) a county described by Subsection (b); and 1-22 (2) a municipality that has a population of less than 1-23 40,000. 1-24 SECTION 2. The importance of this legislation and the 2-1 crowded condition of the calendars in both houses create an 2-2 emergency and an imperative public necessity that the 2-3 constitutional rule requiring bills to be read on three several 2-4 days in each house be suspended, and this rule is hereby suspended, 2-5 and that this Act take effect and be in force from and after its 2-6 passage, and it is so enacted.
