H.B. No. 2952 1-1 AN ACT 1-2 relating to the procedure for service of process, notice, or demand 1-3 on the commissioner of insurance. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 3(f), Article 1.36, Insurance Code, is 1-6 amended to read as follows: 1-7 (f)(1) Upon receiving the return receipt, the commissioner 1-8 shall issue a certificate showing the service and proof of delivery 1-9 by a return receipt for certified or registered mail to the 1-10 plaintiff and clerk of the court or agency where the case is 1-11 pending. 1-12 (2) The commissioner shall provide on request a 1-13 certificate issued by him showing the service and proof of delivery 1-14 by a return receipt for certified or registered mail. The 1-15 commissioner may charge a fee not to exceed $10 for this 1-16 certificate. 1-17 SECTION 2. This Act takes effect September 1, 1995. 1-18 SECTION 3. The importance of this legislation and the 1-19 crowded condition of the calendars in both houses create an 1-20 emergency and an imperative public necessity that the 1-21 constitutional rule requiring bills to be read on three several 1-22 days in each house be suspended, and this rule is hereby suspended.
