    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to the procedure for service of process, notice, or demand
    1-9  on the commissioner of insurance.
   1-10        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-11        SECTION 1.  Section 3(f), Article 1.36, Insurance Code, is
   1-12  amended to read as follows:
   1-13        (f)(1)  Upon receiving the return receipt, the commissioner
   1-14  shall issue a certificate showing the service and proof of delivery
   1-15  by a return receipt for certified or registered mail to the
   1-16  plaintiff and clerk of the court or agency where the case is
   1-17  pending.
   1-18              (2)  The commissioner shall provide on request a
   1-19  certificate issued by him showing the service and proof of delivery
   1-20  by a return receipt for certified or registered mail.  The
   1-21  commissioner may charge a fee not to exceed $10 for this
   1-22  certificate.
   1-23        SECTION 2.  This Act takes effect September 1, 1995.
   1-24        SECTION 3.  The importance of this legislation and the
   1-25  crowded condition of the calendars in both houses create an
   1-26  emergency and an imperative public necessity that the
   1-27  constitutional rule requiring bills to be read on three several
   1-28  days in each house be suspended, and this rule is hereby suspended.
