                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authority of the Upper Sabine Valley Solid Waste
    1-3  Management District over solid waste disposal facilities within its
    1-4  boundaries.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Article 4477-7K, Texas Civil Statutes, is amended
    1-7  by adding Subsection 4.19(f) to read as follows:
    1-8        Sec. 4.19.  Regulation of Solid Waste Disposal.
    1-9        (f)  In the interest of promoting regionalization,
   1-10  notwithstanding other authority under Title 5, Subtitle B of the
   1-11  Health and Safety Code or any other statute, construction or
   1-12  expansion of a solid waste disposal facility may not commence
   1-13  within the district's boundaries without:
   1-14              (1)  A permit or other authorization granted by the
   1-15  commission; and,
   1-16              (2)  Authorization from the district, given by a
   1-17  resolution or other official action after the commission's
   1-18  authorization is obtained.
   1-19        SECTION 2.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
