                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to termination and suspension of certain insurance agency
    1-3  contracts.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 3. Article 21.11-1, Insurance Code, is
    1-6  amended to read as follows:
    1-7        Sec. 3.  The provisions of this article shall not apply to
    1-8  the termination or suspension of an agent's contract for
    1-9  insolvency, abandonment, gross and willful misconduct, or failure
   1-10  to pay over to the company money due to the company after his
   1-11  receipt of a written demand therefore, or after revocation of the
   1-12  agent's license by the State Board of Insurance <nor to the
   1-13  termination or suspension of agents where the policies and the
   1-14  insurance business is owned by the company and not by the agent>.
   1-15        SECTION 2.  This Act applies only to the termination or
   1-16  suspension of an agency contract on or after the effective date of
   1-17  this Act.  Termination or suspension of an agency contract before
   1-18  the effective date of this Act is governed by the law in effect
   1-19  immediately before the effective date of this Act and that law is
   1-20  continued in effect for that purpose.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended,
    2-3  and that this Act take effect and be in force from and after its
    2-4  passage, and it is so enacted.
