                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to a certificate of convenience and public necessity
    1-3  issued to a motor carrier.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  (a)  All certificates of convenience and public
    1-6  necessity issued under Chapter 314, Acts of the 41st Legislature,
    1-7  Regular Session, 1929 (Article 911b, Vernon's Texas Civil
    1-8  Statutes), are canceled.
    1-9        (b)  A person may operate as a motor carrier in this state if
   1-10  the person complies with:
   1-11              (1)  insurance requirements the Texas Department of
   1-12  Transportation adopts by rule; and
   1-13              (2)  motor carrier safety standards the Department of
   1-14  Public Safety of the State of Texas adopts by rule.
   1-15        (c)  A person holding a certificate described by Subsection
   1-16  (a):
   1-17              (1)  shall mail the certificate to the Railroad
   1-18  Commission of Texas for cancellation not later than the 30th day
   1-19  after the effective date of this Act; and
   1-20              (2)  may not operate as a motor carrier unless the
   1-21  person complies with rules adopted under Subsection (b) of this
   1-22  section.
   1-23        SECTION 2.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended,
    2-4  and that this Act take effect and be in force from and after its
    2-5  passage, and it is so enacted.
