                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to continuous insurance policies.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Article 3.70-13, Insurance Code, is amended to
    1-5  read as follows:
    1-6        A guaranteed renewable policy or a noncancellable policy
    1-7  shall be deemed to be a continuous policy, subject only to the
    1-8  terms and conditions thereof, including payment of policy premiums,
    1-9  and such policies shall be considered to be continued in force by
   1-10  the payment of the policy premium in accordance with the policy
   1-11  terms and conditions, and such policies shall not be deemed or
   1-12  treated as renewed policies by the payment of such contracted
   1-13  policy premiums.  <This article does not apply to a health benefit
   1-14  plan adopted in accordance with Chapter 26 of this code, as added
   1-15  by H.B. No. 2055, Acts of the 73rd Legislature, Regular Session,
   1-16  1993.>
   1-17        SECTION 2.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requlring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended,
   1-22  and that this Act take effect and be in force from and after its
   1-23  passage, and it is so enacted.
