    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to definition, sale, and purchase of certain fish.
    1-9        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-10        SECTION 1.  Section 66.111(b), Parks and Wildlife Code, is
   1-11  amended to read as follows:
   1-12        (b)  Subsection (a) of this section does not apply to:
   1-13              (1)  a fish, other than a bass of the genus
   1-14  Micropterus, reared in private water under a fish farmer's license;
   1-15              (2)  a fish possessed legally outside this state and
   1-16  transported into this state;
   1-17              (3)  bass of the genus Micropterus reared in private
   1-18  water under a fish farmer's license and marketed for the purpose of
   1-19  stocking the water of this state;
   1-20              (4)  nongame fish regulated under Chapter 67 of this
   1-21  code; or
   1-22              (5)  channel catfish of more than 14 inches in length
   1-23  or blue catfish of more than 14 inches in length taken from the
   1-24  public fresh water of Angelina, Bowie, Camp, Cass, Chambers,
   1-25  Franklin, Freestone, Gregg, Hardin, Harris, Harrison, Jasper,
   1-26  Jefferson, Lamar, Leon, Liberty, Madison, Marion, Montgomery,
   1-27  Morris, Nacogdoches, Navarro, Newton, Orange, Panola, Polk, Red
   1-28  River, Sabine, San Augustine, San Jacinto, Shelby, Titus, Trinity,
   1-29  Tyler, Upshur, or Walker County, or the public fresh water of the
   1-30  Neches or Trinity River in Houston County<; or>
   1-31              <(6)  minnows to be used as bait fish taken from the
   1-32  public fresh waters in Clay, Cottle, Hardeman, Motley, Wichita, or
   1-33  Wilbarger County>.
   1-34        SECTION 2.  Section 66.114, Parks and Wildlife Code, is
   1-35  amended to read as follows:
   1-36        Sec. 66.114.  <BAIT, ROUGH, AND> GAME AND NONGAME FISH
   1-37  DEFINED:  COMMISSION PROCLAMATION.  The commission by proclamation
   1-38  shall define <as> game and nongame fish <those species of fish
   1-39  having sporting value, define as rough fish those bony or
   1-40  rough-fleshed fish having no sporting value, and define as bait
   1-41  fish those species of fish that may be taken or used as bait fish>.
   1-42        SECTION 3.  Sections 66.023 and 66.024, Parks and Wildlife
   1-43  Code, are repealed.
   1-44        SECTION 4.  This Act takes effect September 1, 1995.
   1-45        SECTION 5.  The importance of this legislation and the
   1-46  crowded condition of the calendars in both houses create an
   1-47  emergency and an imperative public necessity that the
   1-48  constitutional rule requiring bills to be read on three several
   1-49  days in each house be suspended, and this rule is hereby suspended.
