By Gallego H.B. No. 3077 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the appointment of an acting county judge. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Chapter 26, Government Code, is amended by adding 1-5 Section 26.015 to read as follows: 1-6 Sec. 26.015. APPOINTMENT OF ACTING OF COUNTY JUDGE. 1-7 (a) Upon the suspension of a constitutional county judge by the 1-8 State Commission on Judicial Conduct under Art. V, Sec. 1-a, 1-9 Constitution of the State of Texas, the commissioners court shall 1-10 appoint a resident of the county to fill the office until the next 1-11 term of that office or until the suspension ends, whichever event 1-12 occurs first. 1-13 (b) The Commissioners court shall compensate the acting 1-14 judge by the day, week, or month in an amount equal to the 1-15 compensation of the regular judge. For budget amendment purposes 1-16 under Chapter 111, Local Government Code, this requirement shall 1-17 constitute an emergency. 1-18 SECTION 2. This Act takes effect on September 1, 1995. 1-19 SECTION 3. EMERGENCY. The importance of this legislation 1-20 and the crowded condition of the calendars in both houses create an 1-21 emergency and an imperative public necessity that the 1-22 constitutional rule requiring bills to be read on three several 1-23 days in each house be suspended, and this rule is hereby suspended, 2-1 and that this Act take effect and be in force from and after its 2-2 passage, and it is so enacted. 2-3 COMMITTEE AMENDMENT NO. 1 2-4 Amend House Bill 3077 as follows: 2-5 (1) on page 1, line 5, strike "26.015" and substitute 2-6 "26.017"; and 2-7 (2) on page 1, line 6, by striking "26.015" and substituting 2-8 "26.017". 2-9 Thompson
