                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to administrative licensing.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  The Administrative Procedure Act, Tex. Gov't
    1-5  Code, section 2001.054 is amended by the addition of subsection (d)
    1-6  to read as follows:
    1-7        (d)  A license issued under this chapter remains valid unless
    1-8  it expires without timely application for renewal, it is amended,
    1-9  revoked, suspended, annulled or withdrawn, or the denial of a
   1-10  renewal application becomes final.  The term or duration of a
   1-11  license issued under this chapter is tolled during the period the
   1-12  license is subjected to judicial review.  Provided, however, that
   1-13  the term or duration of a license is not tolled if, during judicial
   1-14  review, the licensee engages in the activity for which the license
   1-15  was issued.
   1-16        SECTION 2.  This Act takes effect September 1, 1995, and is
   1-17  applicable to licenses issued under this chapter that are valid and
   1-18  existing on the effective date of this Act.
   1-19        SECTION 3.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity such that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended.
