                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the exemption from dues, fees, and charges provided to
    1-3  a veteran or dependent of a veteran enrolled at a public
    1-4  institution of higher education.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Section 54.203(d), Education Code, is amended to
    1-7  read as follows:
    1-8        (d)  The exemption from fees provided for in Subsection (a)
    1-9  of this section does not apply to a person if at the time of his
   1-10  registration he is eligible for educational benefits under federal
   1-11  legislation in effect at the time of his registration if the value
   1-12  of those benefits is equal to or exceeds the value of the
   1-13  exemption, except that the person must first utilize the federal
   1-14  benefit for which he is eligible and the combined amount of the
   1-15  federal benefit plus the amount of this waiver shall not exceed the
   1-16  maximum value of the waiver.  A person is covered by the exemptions
   1-17  if his right to benefits under federal legislation is extinguished
   1-18  at the time of his registration.
   1-19        SECTION 2.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
