                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the collection and use of fees by, and management of
    1-3  the funds of the Texas Department of Health.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 12.001, Health and Safety Code, is
    1-6  amended by adding subsection (d) to read as follows:
    1-7        (d)  Notwithstanding any other law, the board may set fees
    1-8  for services and activities that the board or the department is
    1-9  required to perform by law.  Fees shall be set in an amount
   1-10  necessary to recover the cost of performing the service or the
   1-11  activity.
   1-12        SECTION 2.  All moneys that the Texas Department of Health is
   1-13  authorized to receive by law from any source shall be deposited in
   1-14  dedicated accounts in the general revenue fund.  These accounts are
   1-15  dedicated to the purposes for which they were established under the
   1-16  applicable provisions of law.  The accounts are exempt from
   1-17  Subsection (b), Section 403.095, Government Code, that would
   1-18  authorize the expenditure or transfer of dedicated revenues
   1-19  inconsistent with this section.
   1-20        SECTION 3.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended,
    2-2  and that this Act take effect and be in force from and after its
    2-3  passage, and it is so enacted.
