                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to certain offenses within view.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Article 14.01 (a), Code of Criminal Procedure, is
    1-5  amended to read as follows:
    1-6        Art. 14.01.  Offense within view.  (a)  A peace officer or
    1-7  any other person, may, without a warrant, arrest an offender when
    1-8  the offense is committed in his presence or within his view, if the
    1-9  offense is one classed as a felony, <or as> an offense against the
   1-10  public peace<.>, or an offense committed under Article 30.05 of the
   1-11  Penal Code.
   1-12        (b)  A peace officer may arrest an offender without a warrant
   1-13  for any offense committed in his presence or within his view.
   1-14        SECTION 2.  This Act takes effect September 1, 1995.
   1-15        SECTION 3.  The importance of this legislation and the
   1-16  crowded condition of the calendars in both houses create an
   1-17  emergency and an imperative public necessity that the
   1-18  constitutional rule requiring bills to be read on three several
   1-19  days in each house be suspended, and this rule is hereby suspended.
