A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the board of directors of the Edwards Aquifer Authority
1-3 and the management of the Edwards Aquifer.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Article 1, Chapter 626, Acts of the 73rd
1-6 Legislature, Regular Session, 1993, is amended by amending Section
1-7 1.09 and by adding Sections 1.091 and 1.092 to read as follows:
1-8 Sec. 1.09. BOARD OF DIRECTORS; ELECTIONS; TERMS. (a) The
1-9 authority is governed by a 15-member board of directors elected
1-10 from the single-member election districts described by Section
1-11 1.092 of this article. Directors serve staggered four-year terms
1-12 with as near as possible to one-half of the members' terms expiring
1-13 December 1 of each odd-numbered year. A director serves until the
1-14 director's successor has been elected and qualifies for office.
1-15 (b) The board shall order elections of the appropriate
1-16 number of directors to replace those whose terms are nearest
1-17 expiration to be held on the uniform election date in November of
1-18 each odd-numbered year.
1-19 (c) If a director's position becomes vacant for any reason,
1-20 the board shall appoint a qualified person to serve until the first
1-21 election of directors following the appointment. If the position
1-22 is not scheduled to be filled at that election, the board shall
1-23 provide for a director to be elected at that election to serve in
1-24 the position for the remainder of the unexpired term. <board of

2-2 <(b) The board consists of:>
2-3 <(1) a member appointed by the South Central Texas
2-4 Water Advisory Committee created by this Act;>
2-5 <(2) three residents of Bexar County, with two
2-6 residents appointed by the governing body of the city of San
2-7 Antonio and one resident appointed by the Commissioners Court of
2-8 Bexar County to represent cities and communities in the county
2-9 other than the city of San Antonio;>
2-10 <(3) one resident of Comal County or the city of New
2-11 Braunfels appointed by the Commissioners Court of Comal County;>
2-12 <(4) one resident of Hays County appointed by the
2-13 governing body of the city of San Marcos;>
2-14 <(5) one resident of Medina County appointed by the
2-15 governing body of the Medina Underground Water Conservation
2-16 District;>
2-17 <(6) one resident of Uvalde County appointed by the
2-18 governing body of the Uvalde Underground Water Conservation
2-19 District; and>
2-20 <(7) one person appointed in rotation who is from
2-21 Atascosa, Medina, or Uvalde counties, with that person appointed by
2-22 the governing body of the Evergreen Underground Water District, by
2-23 the Medina Underground Water Conservation District, or by the
2-24 Uvalde County Underground Water Conservation District, with the
2-25 person appointed by the Evergreen Underground Water District
2-26 serving the first term, followed by a person appointed by the
2-27 Medina Underground Water Conservation District to serve the second
3-1 term, followed by a person appointed by the Uvalde County
3-2 Underground Water Conservation District to serve the third term,
3-3 and rotating in that order of appointment for subsequent terms.>
3-4 <(c) The Commissioners Court of Bexar County and the
3-5 governing body of the city of San Antonio shall make appointments
3-6 under Subsection (b) of this section that accurately reflect the
3-7 ethnic composition of the population of Bexar County.>
3-8 <(d) The initial directors of the board shall draw lots to
3-9 determine their terms. Four initial directors serve terms that
3-10 expire June 1, 1995. Five initial directors serve terms that
3-11 expire June 1, 1997. Subsequent directors shall be appointed to
3-12 serve staggered four-year terms, the appropriate number of which
3-13 expire June 1 of each odd-numbered year.>
3-14 <(e) At the initial meeting of the board, the members shall
3-15 select one member to serve as presiding officer. The presiding
3-16 officer serves a term set by rule of the board not to exceed four
3-17 years. An act of the board is not valid unless adopted by the
3-18 affirmative vote of a majority of the members of the board.>
3-19 <(f) A board member receives no compensation for service on
3-20 the board but is entitled to reimbursement for actual and necessary
3-21 expenses incurred in the performance of the member's duties.>
3-22 <(g) A board member shall hold office until a successor has
3-23 been selected and approved and has qualified by taking the oath of
3-24 office.>
3-25 <(h) If a vacancy on the board occurs, the governing body
3-26 that appointed the vacating member shall appoint another person
3-27 having the same qualifications required of the vacating member to
4-1 serve the unexpired portion of the vacating member's term.>
4-2 Sec. 1.091. INITIAL ELECTION OF DIRECTORS. (a) The initial
4-3 election of directors of the authority shall be ordered and
4-4 conducted by the county clerk of each county a portion of which is
4-5 included in the authority's boundaries. The election shall be held
4-6 on the uniform election date in November 1995, in conjunction with
4-7 other elections held on that date. The county clerk of each county
4-8 shall provide for the names of the candidates for election to the
4-9 office of director from the election districts described by Section
4-10 1.092 of this article that are wholly or partially in the county to
4-11 be printed on the ballots for the elections held on that date or on
4-12 a separate ballot, as appropriate. The county clerk shall conduct
4-13 the election in a manner to ensure that only voters who reside in
4-14 the single-member election districts vote in the election of
4-15 directors.
4-16 (b) For the initial election of directors, the county judge
4-17 of Bexar County shall act as the canvassing board to receive and
4-18 canvass the votes cast in each election district and to declare the
4-19 results of the election. In each county, the election officers
4-20 shall return the results to the commissioners court of the county
4-21 and return all ballot boxes to the county clerk. On receiving the
4-22 election returns, the commissioners court of each county shall
4-23 canvass the returns and certify the results of the election in that
4-24 county to the county judge of Bexar County. The county judge of
4-25 Bexar County shall canvass the returns and certify the results of
4-26 the election to the Texas Natural Resource Conservation Commission
4-27 and the secretary of state.
5-1 (c) The initial directors elected from odd-numbered election
5-2 districts described by Section 1.092 of this article serve terms
5-3 expiring December 1, 1997, and the initial directors elected from
5-4 even-numbered election districts described by that section serve
5-5 terms expiring December 1, 1999.
5-6 Sec. 1.092. SINGLE-MEMBER ELECTION DISTRICTS. (a)
