1-3 AN ACT
1-4 relating to the board of directors of the Edwards Aquifer Authority
1-5 and the management of the Edwards Aquifer.
1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-7 SECTION 1. Section 1.09, Chapter 626, Acts of the 73rd
1-8 Legislature, Regular Session, 1993, is amended to read as follows:
1-9 Sec. 1.09. BOARD OF DIRECTORS; ELECTIONS; TERMS; OFFICERS.
1-10 (a) Until a permanent board of directors qualifies and takes
1-11 office as provided by this section, the <The> authority is governed
1-12 by a temporary board. Temporary directors serve terms that expire
1-13 June 1, 1996. The temporary board consists of:
1-14 (1) two residents of Uvalde County, appointed by the
1-15 Uvalde County Underground Water Conservation District;
1-16 (2) three residents of Medina County or the area of
1-17 Atascosa County that is in the authority, appointed by the Medina
1-18 County Underground Water Conservation District;
1-19 (3) five residents of Bexar County appointed by the
1-20 governing body of the city of San Antonio;
1-21 (4) two residents of Bexar County appointed by the
1-22 commissioners court of Bexar County;
1-23 (5) two residents of Comal County appointed by the
1-24 commissioners court of Comal County;
2-1 (6) two residents of Hays County appointed by the
2-2 governing body of the city of San Marcos; and
2-3 (7) one resident of a county or municipality listed in
2-4 Section 1.10 of this article, appointed by the governor.
2-5 (b) The officials charged with appointing a temporary
2-6 director shall make the appointment on or before September 1, 1995.
2-7 (c) When the temporary directors have qualified, the
2-8 directors shall take the oath of office and meet to select one
2-9 member to serve as presiding officer as soon as is practicable.
2-10 (d) The temporary board shall adopt rules governing the
2-11 procedures for the board and authority.
2-12 (e) If an appointee to the office of temporary director
2-13 fails to qualify or if a vacancy occurs in a temporary director's
2-14 office, the remaining temporary directors shall appoint a person to
2-15 fill the vacancy.
2-16 (f) The permanent board of directors is composed of 15
2-17 voting members elected from the single-member election districts
2-18 described by Section 1.091 of this article, one voting member
2-19 elected from the area described by Section 1.092 of this article,
2-20 and one voting member appointed by the South Central Texas Water
2-21 Advisory Committee. Elected directors serve staggered four-year
2-22 terms expiring June 1 of each odd-numbered year or as provided by
2-23 Section 1.092 of this article. The appointed director must be a
2-24 resident of a county or municipality listed in Section 1.10 of this
2-25 article and serves a term of four years expiring June 1 of the
2-26 fourth year following the date of the director's regular
2-27 appointment.
3-1 (g) The temporary board shall order an election of 16
3-2 initial permanent directors to be held on the uniform election
3-3 date in May 1996.
3-4 (h) Notwithstanding Subsection (f), the initial permanent
3-5 directors elected from the odd-numbered districts described by
3-6 Section 1.091 of this article serve terms that expire June 1, 1997.
3-7 The initial permanent directors elected from the even-numbered
3-8 districts described by Section 1.091 of this article serve terms
3-9 that expire June 1, 1999.
3-10 (i) The board shall order elections of the appropriate
3-11 number of directors to replace those whose terms are nearest
3-12 expiration to be held on the uniform election date in May of each
3-13 odd-numbered year.
3-14 (j) At the first meeting of the board after new directors
3-15 take office, the directors shall take the oath of office and shall
3-16 select one director to serve as presiding officer of the board.
3-17 The presiding officer serves a term set by the board not to exceed
3-18 two years.
3-19 (k) A director may not receive compensation for service on
3-20 the board but is entitled to reimbursement for actual and necessary
3-21 expenses incurred in the performance of the director's duties.
3-22 (l) The board may act only on the affirmative vote of a
3-23 majority of the directors. <board of nine directors.>
3-24 <(b) The board consists of:>
3-25 <(1) a member appointed by the South Central Texas
3-26 Water Advisory Committee created by this Act;>
3-27 <(2) three residents of Bexar County, with two
4-1 residents appointed by the governing body of the city of San
4-2 Antonio and one resident appointed by the Commissioners Court of
4-3 Bexar County to represent cities and communities in the county
4-4 other than the city of San Antonio;>
4-5 <(3) one resident of Comal County or the city of New
4-6 Braunfels appointed by the Commissioners Court of Comal County;>
4-7 <(4) one resident of Hays County appointed by the
4-8 governing body of the city of San Marcos;>
4-9 <(5) one resident of Medina County appointed by the
4-10 governing body of the Medina Underground Water Conservation
4-11 District;>
4-12 <(6) one resident of Uvalde County appointed by the
4-13 governing body of the Uvalde Underground Water Conservation
4-14 District; and>
4-15 <(7) one person appointed in rotation who is from
4-16 Atascosa, Medina, or Uvalde counties, with that person appointed by
4-17 the governing body of the Evergreen Underground Water District, by
4-18 the Medina Underground Water Conservation District, or by the
4-19 Uvalde County Underground Water Conservation District, with the
4-20 person appointed by the Evergreen Underground Water District
4-21 serving the first term, followed by a person appointed by the
4-22 Medina Underground Water Conservation District to serve the second
4-23 term, followed by a person appointed by the Uvalde County
4-24 Underground Water Conservation District to serve the third term,
4-25 and rotating in that order of appointment for subsequent terms.>
4-26 <(c) The Commissioners Court of Bexar County and the
4-27 governing body of the city of San Antonio shall make appointments
5-1 under Subsection (b) of this section that accurately reflect the
5-2 ethnic composition of the population of Bexar County.>
5-3 <(d) The initial directors of the board shall draw lots to
5-4 determine their terms. Four initial directors serve terms that
5-5 expire June 1, 1995. Five initial directors serve terms that
5-6 expire June 1, 1997. Subsequent directors shall be appointed to
5-7 serve staggered four-year terms, the appropriate number of which
5-8 expire June 1 of each odd-numbered year.>
5-9 <(e) At the initial meeting of the board, the members shall

5-12 years. An act of the board is not valid unless adopted by the
5-13 affirmative vote of a majority of the members of the board.>

5-21 that appointed the vacating member shall appoint another person
5-22 having the same qualifications required of the vacating member to
5-23 serve the unexpired portion of the vacating member's term.>

30-20 (p) In this section, the terms "tract," "block," "block
30-21 group," and "BNA" (block numbering area) mean the geographic areas
30-22 identified by those terms in the Redistricting Map Data Base for
30-23 the State of Texas prepared by the Texas Legislative Council and
30-24 distributed by the council to the State Data Center, Texas
30-25 Department of Commerce, on March 22, 1991, for public distribution
30-26 by the State Data Center.
30-27 Sec. 1.092. ALTERNATING ELECTED DIRECTOR. One director
31-1 shall be elected alternately from Uvalde County or from Medina
31-2 County and the area of Atascosa County that is within the authority
31-3 as provided by this section. At the initial election of permanent
31-4 directors in May 1996, the director shall be elected at large from
31-5 the area comprising Medina County and the area of Atascosa County
31-6 that is within the authority. At the election of directors held in
31-7 May 1999, the director shall be elected at large from Uvalde
31-8 County. At the election of directors held every four years
31-9 subsequently, the director shall be elected from those areas in
31-10 alternation.
31-11 SECTION 3. Section 1.10(a), Chapter 626, Acts of the 73rd
31-12 Legislature, Regular Session, 1993, is amended to read as follows:
31-13 (a) The South Central Texas Water Advisory Committee shall
31-14 advise the board on downstream water rights and issues. The
31-15 advisory committee consists of one member appointed by the
31-16 governing body of each of the following counties and
31-17 municipalities<, except that Atascosa County may not have a
31-18 representative on the advisory committee when the county has a

32-14 SECTION 4. The importance of this legislation and the
32-15 crowded condition of the calendars in both houses create an
32-16 emergency and an imperative public necessity that the
32-17 constitutional rule requiring bills to be read on three several
32-18 days in each house be suspended, and this rule is hereby suspended,
32-19 and that this Act take effect and be in force from and after its
32-20 passage, and it is so enacted.
