No. 3196 1-2 (In the Senate - Received from the House May 8, 1995; 1-3 May 9, 1995, read first time and referred to Committee on 1-4 Jurisprudence; May 16, 1995, reported favorably by the following 1-5 vote: Yeas 4, Nays 0; May 16, 1995, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to fees received by a judge or justice for certain 1-9 services. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Chapter 21, Government Code, is amended by adding 1-12 Section 21.003 to read as follows: 1-13 Sec. 21.003. FEE FOR MARRIAGE CEREMONY. A judge or justice 1-14 who performs a marriage ceremony under Section 1.83, Family Code, 1-15 may receive, in addition to a salary, a fee, commission, or payment 1-16 for performing a marriage ceremony. 1-17 SECTION 2. Section 36.07, Penal Code, is amended by adding 1-18 Subsection (d) to read as follows: 1-19 (d) This section does not apply to a judge or justice who 1-20 receives, in addition to a salary, a fee, commission, or payment 1-21 for performing a marriage ceremony under Section 1.83, Family Code. 1-22 SECTION 3. This Act takes effect September 1, 1995. 1-23 SECTION 4. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 1-25 emergency and an imperative public necessity that the 1-26 constitutional rule requiring bills to be read on three several 1-27 days in each house be suspended, and this rule is hereby suspended. 1-28 * * * * *
