A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the board of directors of the Montgomery County
1-3 Hospital District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 4(a), Chapter 258, Acts of the 65th
1-6 Legislature, Regular Session, 1977, is amended to read as follows:
1-7 (a) The district is governed by a board of seven directors.
1-8 Three of the directors shall be elected at large from the entire
1-9 district, and the remaining four directors each shall be elected
1-10 from a different commissioner's precinct in the district, and each
1-11 shall be a resident of the precinct he represents. Candidates to
1-12 represent the district at large shall run by position. A qualified
1-13 elector is entitled to vote for the directors to be elected at
1-14 large and for the director to be elected from the precinct in which
1-15 the elector resides. Directors shall serve for terms of four years
1-16 expiring on the second Tuesday in June. No person may be appointed
1-17 or elected as a member of the board of directors of the hospital
1-18 district unless he is a resident of the district and a qualified
1-19 elector and unless at the time of such election or appointment he
1-20 shall be more than 21 years of age. No person may be appointed or
1-21 elected as a director of the hospital district if he holds another
1-22 appointed or elected public office of honor, trust, or profit. A
1-23 person holding another public office of honor, trust, or profit who
1-24 seeks to be appointed or elected a director automatically vacates
2-1 the first office. <No physician who has hospital privileges in the
2-2 district may be a director; provided the chief of staff may serve
2-3 as an ex officio director without the right to vote as a member of
2-4 the board.> Each member of the board of directors shall serve
2-5 without compensation and shall qualify by executing the
2-6 constitutional oath of office and shall execute a good and
2-7 sufficient bond for $1,000 payable to the district conditioned upon
2-8 the faithful performance of his duties, and the bonds shall be
2-9 deposited with the depository bank of the district for safekeeping.
2-10 SECTION 2. The importance of this legislation and the
2-11 crowded condition of the calendars in both houses create an
2-12 emergency and an imperative public necessity that the
2-13 constitutional rule requiring bills to be read on three several
2-14 days in each house be suspended, and this rule is hereby suspended,
2-15 and that this Act take effect and be in force from and after its
2-16 passage, and it is so enacted.
