1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the board of directors of the Harris-Galveston Coastal
1-9 Subsidence District.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Sections 151.031(a) and (b), Water Code, are
1-12 amended to read as follows:
1-13 (a) The district is governed by a board of directors
1-14 composed of 19 <17> members who serve for two-year, staggered
1-15 terms.
1-16 (b) The board consists of:
1-17 (1) six members from the city in the district having
1-18 the largest population of any city in the district, to be appointed
1-19 by the mayor of that city, one of these members to be a
1-20 representative of industry;
1-21 (2) one member from the city in the district having
1-22 the next largest population of any city in the district, to be
1-23 appointed by the mayor of that city;
1-24 (3) two members from all incorporated cities in
1-25 Galveston County, appointed by the mayors of those cities;
1-26 (4) one member from the city of Baytown, appointed by
1-27 the mayor of that city;
1-28 (5) three <two> members appointed by the commissioners
1-29 court of Harris County, one to be a representative of agriculture,
1-30 <and> one to be a representative of industry, and one to be a
1-31 representative of municipal utility districts, provided that none
1-32 <neither> of these members is a resident of the city in the
1-33 district having the largest population, and provided that the
1-34 representative of municipal utility districts is a resident of a
1-35 municipal utility district in the district;
1-36 (6) three <two> members appointed by the commissioners
1-37 court of Galveston County, one to be a representative of municipal
1-38 utility districts, provided that the representative of municipal
1-39 utility districts is a resident of a municipal utility district in
1-40 the district;
1-41 (7) one member from Harris County chosen by the mayors
1-42 of the cities of Deer Park, Galena Park, La Porte, Nassau Bay, and
1-43 Seabrook and the president of the Clear Lake City Water Authority;
1-44 (8) one member from Harris County chosen by the mayors
1-45 of the cities of West University Place, Southside Place, Bellaire,
1-46 and Jacinto City; and
1-47 (9) one member from Harris County chosen by the mayors
1-48 of the cities of Humble, Piney Point Village, Hedwig Village,
1-49 Bunker Hill Village, Hunters Creek Village, Hilshire Village, and
1-50 the village of Spring Valley.
1-51 SECTION 2. (a) Not later than the 30th day after the
1-52 effective date of this Act, the general manager of the
1-53 Harris-Galveston Coastal Subsidence District shall call and hold a
1-54 meeting at the district's main office for the selection of the two
1-55 additional directors added to the board of directors of the
1-56 district by this Act. The general manager shall mail written
1-57 notice of the time, place, and purpose of the meeting to each
1-58 commissioners court designated in Sections 151.031(b)(5) and (6),
1-59 Water Code, to choose the additional directors. The notice must be
1-60 sent by certified mail, return receipt requested, not later than
1-61 the 10th day before the date set for the meeting.
1-62 (b) The initial new directors appointed under Sections
1-63 151.031(b)(5) and (6), Water Code, as amended by this Act, serve
1-64 until January 31, 1996. Subsequent directors shall be selected to
1-65 fill those positions in the manner and for the terms provided by
1-66 law for selection of other members of the board of directors of the
1-67 Harris-Galveston Coastal Subsidence District whose terms expire in
1-68 even-numbered years.
2-1 SECTION 3. The importance of this legislation and the
2-2 crowded condition of the calendars in both houses create an
2-3 emergency and an imperative public necessity that the
2-4 constitutional rule requiring bills to be read on three several
2-5 days in each house be suspended, and this rule is hereby suspended,
2-6 and that this Act take effect and be in force from and after its
2-7 passage, and it is so enacted.
