                                 CONCURRENT RESOLUTION
    1-1        WHEREAS, Maverick Drilling & Well Service Co., Inc., alleges
    1-2  that:
    1-3        (1)  on or about the latter part of 1991 and the early part
    1-4  of 1992, the Railroad Commission of Texas solicited bids to plug or
    1-5  reenter and plug 14 wells;
    1-6        (2)  it submitted bids and was awarded the bid for plugging
    1-7  or reentering and replugging each of these wells by the commission;
    1-8        (3)  the commission has failed to fully compensate it for the
    1-9  work performed and for the expenses incurred;
   1-10        (4)  as a result, it has been unable to pay its
   1-11  subcontractors who are threatening to pursue legal action against
   1-12  it;
   1-13        (5)  in addition, it has been wrongfully deprived of the bids
   1-14  awarded to it previously by the commission for the plugging of the
   1-15  remaining wells; and
   1-16        (6)  it is entitled to compensation for the work performed
   1-17  and for the remaining bids taken from the company; now, therefore,
   1-18  be it
   1-19        RESOLVED by the Legislature of the State of Texas, That
   1-20  Maverick Drilling & Well Service Co., Inc., is granted permission
   1-21  to sue the State of Texas and the Railroad Commission of Texas
   1-22  subject to Chapter 107, Civil Practice and Remedies Code; and, be
   1-23  it further
   1-24        RESOLVED, That the chairman of the Railroad Commission of
    2-1  Texas be served process as provided by Section 107.002(a)(3), Civil
    2-2  Practice and Remedies Code.
