                              HOUSE CONCURRENT RESOLUTION
    1-1        WHEREAS, Mr. Edward E. Cockerell alleges that:
    1-2              (1)  he is an attorney duly licensed to practice in the
    1-3  State of Texas (State Bar No. 04462000); and that
    1-4              (2)  on or about June 8, 1992 he agreed to represent
    1-5  Ruben Gonzales under the Crime Victims Compensation Act for lost
    1-6  earnings and medical expenses incurred by Mr. Gonzales due to
    1-7  personal injuries he suffered as a result of criminally injurious
    1-8  conduct; and that
    1-9              (3)  Mr. Gonzales' claim was denied by the attorney
   1-10  general and, after following the required administrative appellate
   1-11  procedures, suit was brought as authorized by the Act in the 104th
   1-12  District Court of Taylor County, Texas; and that
   1-13              (4)  The case was tried to a jury; and that
   1-14              (5)  The jury by its answers to the special issues gave
   1-15  its verdict in favor of Ruben Gonzales and the Court entered
   1-16  judgment therefor on April 4, 1994; and that
   1-17              (6)  Citing Section 12 of the Victims Compensation Act
   1-18  in effect at the time of Mr. Gonzales' claim, he submitted an
   1-19  itemized statement for his attorney's fees and out of pocket
   1-20  expenses in the total amount of $5846.86 to the Division Director,
   1-21  Crime Victims Compensation, Office of the Attorney General.  By
   1-22  letter dated June 24, 1994, Richard H. Anderson, Director of that
   1-23  division, stated that he did not have the authority to grant
    2-1  Mr. Cockerell attorney's fees in this matter.
    2-2        RESOLVED by the Legislature of the State of Texas, That
    2-3  Mr. Edward E.  Cockerell is granted permission to sue the State of
    2-4  Texas and the Office of the Attorney General subject to Chapter
    2-5  107, Civil Practice and Remedies Code; and, be it further
    2-6        RESOLVED, That the Office of the Attorney General be served
    2-7  process as provided by Section 107.002(a)(3), Civil Practices and
    2-8  Remedies Code.
