                                  A JOINT RESOLUTION
    1-1  proposing a constitutional amendment to allow the abolition of the
    1-2  office of county treasurer in Red River County.
    1-3        BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subsection (d), Section 44, Article XVI, Texas
    1-5  Constitution, is amended to read as follows:
    1-6        (d)  The office of County Treasurer in the counties of  El
    1-7  Paso, <and> Fayette, and Red River  is abolished.  In El Paso
    1-8  County, the Commissioners Court may employ or contract with a
    1-9  qualified person or may designate another county officer to perform
   1-10  any of the functions that would have been performed by the County
   1-11  Treasurer if the office had not been abolished.  In Fayette County,
   1-12  the functions of the abolished office are transferred to the County
   1-13  Auditor or to the officer who succeeds to the auditor's functions.
   1-14  In Red River County, the functions of the office are transferred to
   1-15  the county officer or employee designated by the Commissioners
   1-16  Court, and the Commissioners Court may from time to time change its
   1-17  designation as it considers appropriate.  However, the office of
   1-18  County Treasurer in El Paso, <or> Fayette, or Red River County is
   1-19  abolished under this subsection only if, at the statewide election
   1-20  at which the constitutional amendment providing for the abolition
   1-21  of the office in that county is submitted to the voters, a majority
   1-22  of the voters of that county voting on the question at that
   1-23  election favor the amendment.
   1-24        SECTION 2.  The following temporary provision is added to the
    2-1  Texas Constitution:
    2-2        TEMPORARY PROVISION.  The abolition of the office of county
    2-3  treasurer in Red River County under the constitutional amendment
    2-4  proposed by the 74th Legislature, Regular Session, 1995, providing
    2-5  for the abolition of that office in that county takes effect
    2-6  January 1, 1996, if the conditions of Subsection (d), Section 44,
    2-7  Article XVI, as amended by that constitutional amendment, are met.
    2-8  This provision expires January 2, 1996.
    2-9        SECTION 3.  This proposed constitutional amendment shall be
   2-10  submitted to the voters at an election to be held November 7, 1995.
   2-11  The ballot shall be printed to permit voting for or against the
   2-12  proposition:  "The constitutional amendment providing for the
   2-13  abolition of the office of county treasurer in Red River County."
