                                  A JOINT RESOLUTION
    1-1  proposing a constitutional amendment requiring consent for use of
    1-2  and compensation for damages to private property and releasing
    1-3  property owners from liability to persons using property without
    1-4  consent.
    1-5        BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Article I of the Texas Constitution is amended by
    1-7  adding Section 17a to read as follows:
    1-8        Sec. 17a.  (a)  A person who uses an owner's private property
    1-9  without the owner's consent is liable to the owner for damages
   1-10  resulting from the violation.  The legislature by general law may
   1-11  specify or regulate the damages provided for by this subsection.
   1-12        (b)  A private property owner is not liable for damages to a
   1-13  person who uses the owner's private property without the owner's
   1-14  consent.
   1-15        SECTION 2.  This proposed constitutional amendment shall be
   1-16  submitted to the voters at an election to be held November 7, 1995.
   1-17  The ballot shall be printed to provide for voting for or against
   1-18  the proposition:  "The constitutional amendment requiring consent
   1-19  for use of and compensation for damages to private property and
   1-20  releasing property owners from liability to persons using property
   1-21  without consent."
