                                  A JOINT RESOLUTION
    1-1  proposing a constitutional amendment authorizing the interest on
    1-2  certain special constitutional accounts to be credited to the
    1-3  general revenue fund.
    1-4        BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 7, Article VIII, Texas Constitution, is
    1-6  amended to read as follows:
    1-7        Sec. 7.  (a)  The Legislature shall not have power to borrow,
    1-8  or, except as provided by Subsection (b) of this section, in any
    1-9  manner divert from its purpose, any special fund that may, or ought
   1-10  to, come into the Treasury; and shall make it penal for any person
   1-11  or persons to borrow, withhold or in any manner to divert from its
   1-12  purpose any special fund, or any part thereof.
   1-13        (b)  Notwithstanding any other provision of this
   1-14  constitution, the Legislature may provide for the allocation of
   1-15  interest that accrues to a special fund or account to be credited
   1-16  to the special fund or account or to the general revenue fund.
   1-17        (c)  Subsection (b) of this section does not apply to
   1-18  interest that accrues to a special fund or account established to
   1-19  benefit the public schools, public institutions of higher
   1-20  education, or the students at those schools or institutions.
   1-21        SECTION 2.  The following temporary provision is added to the
   1-22  Texas Constitution:
   1-23        TEMPORARY PROVISION.  (a)  This temporary provision applies
   1-24  to the constitutional amendment proposed by the 74th Legislature,
    2-1  Regular Session, 1995, authorizing the legislature to allocate
    2-2  interest from certain special funds or accounts to the general
    2-3  revenue fund.
    2-4        (b)  The amendment takes effect January 1, 1996.
    2-5        (c)  This temporary provision expires January 2, 1996.
    2-6        SECTION 3.  The proposed constitutional amendment shall be
    2-7  submitted to the voters at an election to be held on November 7,
    2-8  1995.  The ballot shall be printed to provide for voting for or
    2-9  against the proposition:  "The constitutional amendment granting
   2-10  the legislature the authority to deposit interest accruing to
   2-11  constitutional special funds or accounts to the credit of the
   2-12  general revenue fund to be used for general governmental purposes."
