                                  A JOINT RESOLUTION
    1-1  proposing a constitutional amendment prohibiting discrimination
    1-2  against or preferential treatment of a person by the state, an
    1-3  agent of the state, or a political subdivision of the state in
    1-4  public employment, public education, or public contracting.
    1-5        BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Article XVI, Texas Constitution, is amended by
    1-7  adding Section 72 to read as follows:
    1-8        Sec. 72.  (a)  The state, an agent of the state, or a
    1-9  political subdivision of the state may not discriminate against or
   1-10  grant preferential treatment to a person because of the person's
   1-11  race, sex, color, ethnicity, or national origin in the operation of
   1-12  the state's system of public employment, public education, or
   1-13  public contracting.
   1-14        (b)  This section applies only to action taken by the state,
   1-15  an agent of the state, or a political subdivision of the state on
   1-16  or after January 1, 1996.
   1-17        SECTION 2.  This proposed constitutional amendment shall be
   1-18  submitted to the voters at an election to be held November 7, 1995.
   1-19  The ballot shall be printed to permit voting for or against the
   1-20  proposition:  "The constitutional amendment to prohibit
   1-21  discrimination against or preferential treatment of a person by the
   1-22  state, an agent of the state, or a political subdivision of the
   1-23  state in public employment, public education, or public
    2-1  contracting."
