                                  A JOINT RESOLUTION
    1-1  proposing a constitutional amendment limiting judicial involvement
    1-2  regarding funding and operation of public free schools to the
    1-3  supreme court.
    1-4        BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Article V of the Texas Constitution is amended by
    1-6  adding Section 3-d to read as follows:
    1-7        Sec. 3-d.  Notwithstanding the writ power granted to courts
    1-8  by this constitution, only the supreme court may issue an order
    1-9  that the system of public free schools be closed or prohibited from
   1-10  operating, that funds allocated to  public free schools be diverted
   1-11  or withheld from their dedicated use, or that funds in the state
   1-12  treasury dedicated to or appropriated for the purpose of funding a
   1-13  system of public free schools be confiscated or prohibited from
   1-14  distribution.
   1-15        SECTION 2.  This proposed constitutional amendment shall be
   1-16  submitted to the voters at an election to be held on November 7,
   1-17  1995.  The ballot shall be printed to provide for voting for or
   1-18  against the proposition:  "The constitutional amendment limiting
   1-19  judicial involvement regarding the funding of public schools to the
   1-20  Texas Supreme Court."
