H.R. No. 1187
R E S O L U T I O N
1-1 BE IT RESOLVED by the House of Representatives of the State
1-2 of Texas, 74th Legislature, Regular Session, 1995, That House Rule
1-3 13, Section 9(a), be suspended in part as provided by House Rule
1-4 13, Section 9(f), to enable the conference committee appointed to
1-5 resolve the differences on Senate Bill No. 1128 to consider and
1-6 take action on the following specific matters:
1-7 1. House Rule 13, Section 9(a)(4), is suspended to permit
1-8 the committee to add a new Section 31 to the bill to read as
1-9 follows:
1-10 SECTION 31. Sections 16.260(b), (c), and (d), Education
1-11 Code, are amended to read as follows:
1-12 (b) Payments from the foundation school fund to each
1-13 category 1 school district shall be made as follows:
1-14 (1) 15 <21> percent of the yearly entitlement of the
1-15 district shall be paid in an installment <two equal installments>
1-16 to be made on or before the 25th day of September <and October> of
1-17 a fiscal year;
1-18 (2) 80 <57> percent of the yearly entitlement of the
1-19 district shall be paid in eight <six> equal installments to be made
1-20 on or before the 25th day of October, November, December, January,
1-21 <February,> March, May, June, and July; and
1-22 (3) five <22> percent of the yearly entitlement of the
1-23 district shall be paid in an installment <two equal installments>
1-24 to be made on or before the 25th day of February <April and May>.
2-1 (c) Payments from the foundation school fund to each
2-2 category 2 school district shall be made as follows:
2-3 (1) 22 <21> percent of the yearly entitlement of the
2-4 district shall be paid in an installment <two equal installments>
2-5 to be made on or before the 25th day of September <and October> of
2-6 a fiscal year;
2-7 (2) 18 <38> percent of the yearly entitlement of the
2-8 district shall be paid in an installment <four equal installments>
2-9 to be made on or before the 25th day of October <November,
2-10 December, March, and July>;
2-11 (3) 9.5 <seven> percent of the yearly entitlement of
2-12 the district shall be paid in an installment <two equal
2-13 installments> to be made on or before the 25th day of November
2-14 <January and February>;
2-15 (4) 7.5 <22> percent of the yearly entitlement of the
2-16 district shall be paid in an installment <two equal installments>
2-17 to be made on or before the 25th day of April <and May>; <and>
2-18 (5) five <12> percent of the yearly entitlement of the
2-19 district shall be paid in an installment <two equal installments>
2-20 to be made on or before the 25th day of May <June and August>;
2-21 (6) 10 percent of the yearly entitlement of the
2-22 district shall be paid in an installment to be made on or before
2-23 the 25th day of June;
2-24 (7) 13 percent of the yearly entitlement of the
2-25 district shall be paid in an installment to be made on or before
2-26 the 25th day of July; and
2-27 (8) 15 percent of the yearly entitlement of the
3-1 district shall be paid in an installment to be made on or before
3-2 the 25th day of August.
3-3 (d) Payments from the foundation school fund to each
3-4 category 3 school district shall be made as follows:
3-5 (1) 45 <21> percent of the yearly entitlement of the
3-6 district shall be paid in an installment <two equal installments>
3-7 to be made on or before the 25th day of September <and October> of
3-8 a fiscal year;
3-9 (2) 35 <57> percent of the yearly entitlement of the
3-10 district shall be paid in an installment <six equal installments>
3-11 to be made on or before the 25th day of October <November,
3-12 December, March, June, July, and August>; and
3-13 (3) 20 <22> percent of the yearly entitlement of the
3-14 district shall be paid in an installment <two equal installments>
3-15 to be made on or before the 25th day of August <April and May>.
3-16 Explanation: This addition is necessary to enable the state
3-17 to accelerate payments from the foundation school fund.
3-18 2. House Rule 13, Section 9(a)(4), is suspended to permit
3-19 the committee to add Subsection (c) to Section 32 of the bill,
3-20 renumbered as Section 33, to read as follows:
3-21 (c) The change in law made by this Act in Section 16.260,
3-22 Education Code, prevails over any conflicting Act of the 74th
3-23 Legislature, Regular Session, 1995, including Senate Bill No. 1,
3-24 regardless of the relative dates of enactment.
3-25 Explanation: This addition is necessary for the preceding
3-26 addition, relating to distribution of the foundation school fund,
3-27 to become effective.
