H.R. No. 1226
                                  R E S O L U T I O N
    1-1        BE IT RESOLVED by the House of Representatives of the State
    1-2  of Texas, 74th Legislature, Regular Session, 1995, That House Rule
    1-3  13, Section 9(a), be suspended in part as provided by House Rule
    1-4  13, Section 9(f), to enable the conference committee appointed to
    1-5  resolve the differences on House Bill No.  3021 to consider and
    1-6  take action on the following specific matters:
    1-7        (1)  House Rule 13, Section 9(a)(4) is suspended to permit
    1-8  the committee to amend Section 11, Bingo Enabling Act (Article
    1-9  179d, Vernon's Texas Civil Statutes), by adding the following text
   1-10  to Subsection (v):  No more than 30 percent of gross bingo game
   1-11  sales at each bingo occasion can be on electronic or mechanical
   1-12  card minding devices.  This provision does not include pull tabs,
   1-13  instant bingo tickets, or break-open bingo games.
   1-14        Explanation:  This provision is necessary to limit the number
   1-15  of card minding devices sold at each bingo occasion and to assure
   1-16  that paper cards will be sold.
   1-17        (2)  House Rule 13, Sections 9(a)(1), (3), and (4) are
   1-18  suspended to permit the committee to amend Section 18, Bingo
   1-19  Enabling Act (Article 179d, Vernon's Texas Civil Statutes), to read
   1-20  as follows:
   1-21        Sec. 18.  FREQUENCY AND TIMES OF GAMES.  An occasion <A game>
   1-22  of bingo may not be conducted under any license issued under this
   1-23  Act more often than three days per calendar week, not to exceed
   1-24  four hours per 24-hour period.  A licensed organization may conduct
    2-1  two occasions per 24-hour period.  <Only one bingo occasion per day
    2-2  may be conducted under each license issued under this Act.>  No
    2-3  more than two organizations may conduct a game of bingo in one
    2-4  place on one 24-hour period <day>.  If two organizations conduct
    2-5  games of bingo in one place on one 24-hour period <day>, these
    2-6  occasions must be announced separately, and an intermission of at
    2-7  least 10 <30> minutes must occur between the games.  No more than
    2-8  two bingo occasions per day may be conducted at any location except
    2-9  that a third occasion per day may be conducted at any location
   2-10  except that a third occasion may be conducted under a temporary
   2-11  license held by a licensed authorized organization at that
   2-12  location.  No more than seven licensed authorized organizations may
   2-13  conduct bingo at any bingo premises.  <A game conducted under a
   2-14  temporary license may not be conducted in violation of this
   2-15  section.>
   2-16        Explanation:  These changes are necessary to make the terms
   2-17  consistent in both versions and to limit the number of licensed
   2-18  authorized organizations that may conduct bingo at a bingo
   2-19  premises.
   2-20        (3)  House Rule 13, Section 9(a)(4) is suspended to permit
   2-21  the committee to add the following provision to read as follows:
   2-22        Nothing in this Act shall be construed as authorizing any
   2-23  game using a video lottery machine or machines.  In this
   2-24  subsection, "video lottery machine" or "machine" means any
   2-25  electronic video game machine that, upon insertion of cash, is
   2-26  available to play or simulate the play of a video game, including
   2-27  but not limited to video poker, keno, and blackjack, utilizing a
    3-1  video display and microprocessor in which the player may receive
    3-2  free games or credits that can be redeemed for cash, coins, or
    3-3  tokens, or that directly dispenses cash, coins, or tokens.
    3-4        Explanation:  This change is necessary to prohibit video
    3-5  lotteries.
